The author of the opinion analyses a petition proposing an amendment to the provisions of the Code of Administrative Procedure in the direction of imposing an obligation on an organ of public administration to verify a submitted application in terms of formality within 7 days from the date of submission, under pain of the impossibility of leaving the application unprocessed. In the author’s opinion, the objective of the petition can be achieved by means of the existing institution of a reminder. As regards the impossibility of leaving the application unprocessed after the expiry of 7 days, the petition’s request should be considered unfounded.
