Celem niniejszego artykułu jest przybliżenie określenia pojęcia nadzoru inwestorskiego oraz wzajemnych zależności z inspektorem nadzoru inwestorskiego określonym w prawie budowlanym. Przedstawiono status prawny inspektorów nadzoru (w tym inspektorów branżowych) wynikający zarówno z obowiązujących przepisów, jak i innych uwarunkowań. Omówiono także uregulowania dotyczące określenia inwestora zastępczego.

The article looks at the concept of investor supervision and mutual dependence of the investor's supervision inspector specified in the construction law as well as at the legal status of inspectors (including industry inspectors) resulting from both the applicable regulations and other conditions. The article overviews the regulations concerning a substitute investor.

Changes made to the administration system in Poland in the years 1989–1990 were aimed at decentralising state government and increasing the importance of local government bodies. The author of this article reckons that this idea has not been reflected in the Polish body of law yet. There are no legal regulations provided in the provisions of law – not only in terms of the legal situation of historic preservation offices but also with regard to deciding what should fall under the authority of local government bodies. Scope of duties of local government historic preservation officers working in separate offices should be similar to the one that individual departments have. Moreover, authority should no longer be granted on discretionary basis. A principle should be therefore formulated that everything what comes within the competence of historic preservation officers must comply with statutory legislation. If a local government body wants to be delegated either full or partial authority, it should prove that it has both organisational and financial capacity to exercise it. We should therefore work towards a complete solution which would be practical and possible to adopt on both state and regional scale.

Obowiązujące reguły dotyczące klasyfikacji nauk i uwzględniające obszary wiedzy, dziedziny nauki i dyscypliny naukowe w swojej treści nie dostrzegają potrzeby wydzielenia logistyki jako oddzielnej dyscypliny naukowej. Niejako konsekwencją tego jest dość swobodne definiowanie terminu logistyka jak i określenia system logistyczny stanowiący integralną część przedsiębiorstwa. Prowadzone badania wskazują na konieczność dokonania zmian w obowiązujących strukturach organizacyjnych systemu logistycznego przedsiębiorstwa. Istotne zatem jest aby dokonywane zmiany miały u podstaw nie tylko ustalenia typowo teoretyczne ale wspierały się wiedzą praktyczną osób realnie pełniących obowiązki na stanowiskach logistycznych lub związanych z logistyką. Umiejętne połączenie teorii z praktyką stwarza podstawy do stwierdzenia, że efektem tych zabiegów będzie struktura odpowiadająca wymogom gospodarki rynkowej XXI wieku.

The existing rules on the classification of Sciences and taking into account the areas of knowledge, science, and scientific rigor in its content does not see the need for separation of logistics as a separate scientific discipline. Somehow the consequence of this is a pretty loose definition of the term logistics and determine the logistics system forming an integral part of the company. Conducted studies indicate the need to make changes in the existing organizational structures of the logistical system of the company. It is therefore important that the changes were at the heart of not only determine the typical theoretical but practical knowledge to support people realistically officiating responsibilities for logistics or related to logistics. A skillful combination of theory with practice gives rise to the conclusion that the effect of these treatments will be the structure corresponding to the requirements of a market economy in the 21st century.

Zgodnie z Dziennikiem Ustaw 2003.207.2016, Ustawa z dnia 7 lipca 1994 r. Prawo budowlane [1], kierownik budowy ma wiele obowiązków. W zakresie jego obowiązków jest np. prowadzenie dokumentacji budowy, realizacja zaleceń wpisanych do dziennika budowy; zgłaszanie inwestorowi do sprawdzenia lub odbioru wykonanych robót ulegających zakryciu bądź zanikających; przygotowanie dokumentacji powykonawczej obiektu budowlanego. Kierownik budowy powinien również poczuwać się do odpowiedzialności za sytuacje, które nie są objęte prawem a powinny wynikać z posiadającej wiedzy z zakresu budownictwa. Od jego postępowania i sposobu prowadzenia budowy zależy, w jaki sposób przebiegać będzie proces inwestycyjny. Nadzorowanie budowy, prowadzenie w sposób rzetelny i czytelny książki budowy są nadrzędnymi obowiązkami kierownika budowy. Co przeoczono lub czego nie dopilnowano na tej budowie? W artykule została opisana sytuacja, która zaistniała na budowie budynku przemysłowego, hali produkcyjno-montażowej, gdzie podczas montażu stalowych słupów zaczęły pękać cokoły stóp fundamentowych.

The Construction Law of 7 July 1994 (Dz.U. 2003.207.2016) [1] assigns a large number of duties to the construction manager. They include, for example, maintaining the documentation of the construction project, implementing recommendations entered in the building log, notifying the investor of the need to check or accept works which are to be concealed, and preparing as-built documentation for the building. The construction manager should also take responsibility for situations which are not specified by law, but ought to be covered by his or her construction expertise. The manager’s actions and manner of executing the construction project will determine the course of the development process. Supervising the project, and keeping the building log in a reliable and legible manner, are prime responsibilities of the construction manager. It is necessary to consider what has been missed or not properly taken care of in a given construction project. This article describes a situation that arose during the construction of an industrial production and assembly facility, when cracks appeared in the footing pedestals during the erection of steel pillars.
