The military sector represented and controlled by the Ministry of National Defense is an extremely important sector in the activities of the state. In this article, the author reviews the legal protection of the effects of innovative activities that ensure the implementation of defense tasks by institutes supervised by the Ministry of National Defense.

In the article, the authors characterized innovativeness of enterprises. The authors compared, using the most frequently applied criterion of evaluation, the level of innovation in Polish enterprises to that of the more developed countries of the European Union. The evaluation results show that the index of innovativeness of the latter is considerably higher than that of the former. At the same time, for the last few years, a decrease of the Polish enterprises innovativeness has been observed. Existence of lots of barriers (making grow of innovation of Polish enterprises more difficult) and also lack of possibilities of beating those barriers by enterprises itself requires creating adequate pro-innovation policy from the Polish government.

This article presents some of the complex aspects of intellectual and industrial property rights in the area of innovative machines, tools, devices as well as chemical compositions, software processes, manufacture articles, etc. The main aim of the paper is to stress the importance of industrial property right in patenting procedures. Moreover, the author's computer-aided system dedicated to industrial property rights is particularly described.

W artykule zaprezentowano wybrane aspekty ochrony własności intelektualnej i przemysłowej w obszarze patentowania innowacyjnych maszyn, narzędzi, urządzeń, jak również kompozytów chemicznych, produktów produkcyjnych itd. Głównym celem artykułu jest podkreślenie wagi ochrony własności przemysłowej w procedurach patentowania. Co więcej, przedstawiono autorski system informatyczny dedykowany w szczególności ochronie własności przemysłowej.

Artykuł prezentuje najważniejsze zagadnienia związane z ochroną własności przemysłowej. Przedstawiono genezę tej ochrony, zwracając szczególną u wagę na jej wymiar międzynarodowy, regionalny, a także krajowy. Następnie, prezentując przedmioty ochrony własności przemysłowej, przybliżono skutki udzielenia praw dla przedsiębiorstw i osób fizycznych, będących autorami zgłoszeń. W dalszej części artykułu zaprezentowano zasady zgłaszania rozwiązań i oznaczeń do ochrony, skutki naruszenia praw, ich ograniczenie w sensie terytorialnym i czasowym oraz inne aspekty z tym związane. Starano się uwypuklić również te elementy przedmiotów ochrony własności przemysłowej, które w pewnym sensie posiadają aspekt jakościowy, decydujący o możliwości ubiegania się o ochronę oraz przyznania jej przez Urząd Patentowy Rzeczypospolitej Polskiej.

The main purpose of this article is to thoroughly outline all relevant issues concerning the legal protection of viable industrial property rights. The history of industrial property protection is widely discussed, with a clear emphasis put firmly on its global, domestic as well as regional dimensions. Having in mind certain industrial brands, subjected to the industrial property protection, under the respected regulations of the Polish Law, the article's author has done his best to thoroughly explain the expected results of granting certain protection rights upon the legal entities as well as individuals at stake. In the subsequent parts of this article a wide-range of highly relevant issues were discussed (incl., for instance the following ones: the legal conditions, allowing to seek the legal protection of vital knowledge and intellectual property as well as registered brands, the legal consequences, deemed as a direct result of property rights violation. Given the widely-held assumption that the quality considerations do tend to take a central stage as far as the development of knowledge-based inventions is concerned, the article's author has markedly shifted his attention to let us better understand the role of quality-involving factors in the wider realm of pending industrial property protection constraints, stipulated by the Polish Republic Patent Rights Protection Office.
