Koncepcja instytucji katastru jako organizacji odpowiedzialnej za utrzymanie ładu prawnego gruntów

Głównym celem artykułu jest przedstawienie koncepcji administracji katastralnej - organizacji o charakterze administracji publicznej odpowiedzialnej za utrzymanie ładu prawnego gruntów oraz uzasadnienie potrzeby jej utworzenia. W artykule przedstawiono proces tworzenia koncepcji z wykorzystaniem instrumentów organizacji i zarządzania. W dwóch częściach, badawczej i koncepcyjnej, opisano poszczególne etapy tego procesu. W części badawczej wykazano celowość skracania procesu inwestycyjnego, określono udział geodezji i kartografii w tym procesie. Przedstawiono także wyniki analizy kluczowych procesów, w których uczestniczy administracja geodezyjna i kartograficzna oraz wyniki badań istotnych parametrów organizacyjnych służby geodezyjnej i kartograficznej (ze szczególnym uwzględnieniem powiatowej administracji geodezyjnej i kartograficznej). W części drugiej zaprezentowano koncepcje rozwiązań organizacyjnych, niezbędnych dla utrzymania w Polsce ładu prawnego gruntów, a także zapewniających systemowe wsparcie inwestora poprzez zagwarantowanie mu dostępu do informacji niezbędnej w procesie inwestycyjnym. Wychodząc od koncepcji procesów określono elementy struktury organizacyjnej administracji katastralnej i jej konfigurację w aparacie administracyjnym państwa. Przedstawiono także przepływy finansowe związane z wprowadzeniem zmian oraz określono termin zwrotu poniesionych nakładów.

The main aim of the article is to present the concept of cadastral administration - an organizational form of public administration responsible for maintaining the legal order of lands and also to justify the need for its creation. The article describes the process of creating the cadastral concept using the organization and management instruments. In the research and conceptual parts all stages of this process are investigated. In the research part the need for shortening the investment process is discussed and the contribution of geodesy and cartography to his process is determined. This part also examines the analysis results of key terms in which geodetic and cartographic administration participates and the results of research on significant organizational parameters of geodetic and cartographic service (with a special focus on the county geodetic and cartographic administration). The second part of the article offers proposals for organizational solutions, needed to maintain the legal order of lands in Poland and also to ensure investor’s system support by providing him access to information essential in the investment process. Starting with the concept of processes, elements of the organizational structure of cadastral administration and its configuration in the state administrative apparatus have been determined. In addition, financial flows connected with implementing changes are presented together with specification of the payback period.

The system of works serving land reform consists mainly of: water melioration, agrotechnical melioration, forest melioration, fitomelioration and land reclamation. The paper presents the identification of land reform operations on the background of their systematics, the degree of complexity of separate types of works and the place of land reclamation in this system. The improvement of spatial organizational conditions bases mainly on land consolidation procedures, while improvement of technical conditions bases mainly on introduction of measures in the range of basic meliorations.
