W artykule dokonano wykładni przepisu § 31 rozporządzenia sprawie ewidencji gruntów i budynków przy zastosowaniu dyrektyw wykładni językowej, systemowej i funkcjonalnej celem ustalenia rozumienia zakodowanej w nim normy prawnej i usunięcia wątpliwości dotyczących możliwości zastosowania w praktyce geodezyjnej procedury ustalania przebiegu granic działek ewidencyjnych. Wykazano, iż komentowany przepis pozostaje w wyraźnej sprzeczności z treścią innych norm prawa regulujących problematykę ustalania granic nieruchomości (zapisanych w rozdziale 6 Prawa geodezyjnego i kartograficznego), a jego stosowanie w praktyce prowadzić może do nieuprawnionych rozstrzygnięć, tj. korygowania przebiegu granic prawnych ustalonych w trybie administracyjnym lub sądowym. We wnioskach końcowych sformułowano postulat, aby do czasu jego zmiany był on stosowany w praktyce z uwzględnieniem wykładni systemowej, tj. przepisów rozdziału 6 p.g.k.

The article interprets the provision of § 31 of the regulation on land and building records with the use of linguistic, systemic and functional interpretations directives in order to establish the understanding of the legal norm encoded therein and remove doubts regarding the applicability in geodetic practice of the procedure for determining the boundaries of registration plots. It has been shown that the commented provision clearly contradicts the content of other legal norms regulating the issues of determining the boundaries of real estate (provided for in chapter 6 of the Geodetic and Cartographic Law), and its application in practice may lead to unauthorized decisions, i.e. correcting the course of established legal boundaries under the administrative or judicial procedure. In the final conclusions, a postulate was formulated that until it is changed, it should be applied in practice, taking into account the systemic interpretation, i.e. the provisions of chapter 6 of the Geodetic and Cartographic Law.

Wspólnoty gruntowe, mimo iż są reliktem stosunków feudalnych, wzbudzają obecnie duże zainteresowanie. Dzieje się tak przede wszystkim ze względu na rozległość stanowiących je nieruchomości oraz atrakcyjność położenia. Chociaż prawnie, wspólnoty gruntowe powinny zostać uregulowane w latach 60. ubiegłego wieku, starostwa w dalszym ciągu prowadzą postępowania mające na celu uregulowanie ich stanu. Jest to spowodowane przede wszystkim brakiem lub niekompletnością dokumentacji powstałej blisko 60 lat temu oraz dużym zainteresowaniem stron dotyczącym ujawnienia ich w wykazie uprawnionych do korzystania z gruntów wspólnoty. Celem artykułu jest zwrócenie uwagi na obowiązki, które spoczywają na organach administracji, zarówno w kwestii ustalenia wspólnoty gruntowej, jak również zadań związanych z późniejszym ewidencjonowaniem danych dotyczących wspólnot.

Ground communities, despite the fact that they are a relic of feudal relations, now arouse great interest. This is mainly due to the vastness of the properties that constitute them and the attractiveness of the location. Although legally, land communities should be regulated in the 1960s, the elders continue to conduct proceedings to regulate their condition. This is mainly due to the lack or incompleteness of the documentation created nearly 60 years ago and the parties' great interest in disclosing them to the list of those entitled to use the community land. The aim of the article is to draw attention to the duties that rest on the administration bodies both in the matter of determining the community of land, as well as tasks related to the subsequent recording of data on communities.

Na terenie województwa podlaskiego funkcjonuje wiele wspólnot gruntowych, które dysponują setkami hektarów gruntów rolnych, leśnych, łąk i stawów. Grunty wspólnot należą do obszarów najbardziej zaniedbanych gospodarczo. W dodatku większość wspólnot gruntowych nie ma uporządkowanego stanu prawnego. Niniejszy artykuł przedstawia analizę wspólnot gruntowych położonych na terenie województwa podlaskiego. Ma na celu pokazanie, jak potrzebne jest objęcie tych gruntów postępowaniem scaleniowym, celem uregulowania ich stanu prawnego i dokonania podziału.

There are many ground communities in Podlaskie Voivodship that have hundreds of hectares of agricultural and forest land, fears and ponds. Community land belongs to the most economically neglected areas. In addition, most land communities have no orderly legal status. This article presents the analysis of ground communities located in the Podlasie Voivodeship. It aims to show, how it is necessary to include these lands in a merger procedure to regulate their legal status and divide them.
