Ochrona gruntów i lasów jest zadaniem powszechnym i znajduje się w zainteresowaniu wielu dyscyplin naukowych, administracji rządowej i samorządowej, a także posiadaczy nieruchomości. Z tego tytułu występuje szereg ograniczeń w gospodarowaniu nieruchomościami i ma to wpływ na wartość rynkową nieruchomości. Z tych powodów zagadnienia ochrony gruntów rolnych i lasów są przedmiotem zainteresowania rzeczoznawców majątkowych, którzy w tym zakresie mają także swój udział bezpośredni, dokonując określenia wartości dla potrzeb związanych z realizacją przepisów prawnych dotyczących ochrony gruntów rolnych i leśnych. Niniejsze opracowanie ma celu przedstawienie ograniczeń w korzystaniu z nieruchomości oraz ukazaniu zadań rzeczoznawców majątkowych wynikających z aktów prawnych dotyczących ochrony gruntów rolnych i lasów.

Protection of land and forests is a universal project and is in the interest of many scientific disciplines, government and local government, as well as holders of real-estate. In this respect, there are a number of restrictions on real estate management and this has an impact on the market value of the property. For these reasons, the issue of protection of agricultural land and forests are of interest appraisers, who in this respect have also contributed directly by making a determination of the value for con-related to the implementation of the legislation on protection of agricultural land and forests. Ni-important paper aims to present the restrictions on the use of real estate and property appraisers release of the tasks arising from instruments for the protection of agricultural land and forests.

The possibility of utilization of agricultural and forest lands for the investment purposes is associated both with the change in their purpose, as set forth in a local development plan, as well as with administrative proceedings which would allow their actual exclusion from production. The Agricultural and Forest Land Protection Act, amended at the end of 2008, liberated the hitherto regulations by excluding agricultural lands utilized as crop lands and located within the cities corporate limits from the regulations of this act. At the same time, the necessity to obtain permission of higher competent authorities to designate land for investment purposes in the local development plan was limited. The article presents: the authorities who grant their approval to alter the purpose of the land in a local plan, the changes in the scope crop land types requiring a decision on exclusion, as well as the changes in competences of the authorities and the possibilities of reducing fees for exclusion of lands from agricultural production and forestry over the past 15 years.

Możliwość wykorzystania gruntów rolnych i leśnych na cele inwestycyjne wiąże się zarówno ze zmianą ich przeznaczenia ujętą w miejscowym planie zagospodarowania przestrzennego, jak i realizacją postępowania administracyjnego zezwalającego na ich faktyczne wyłączenie z produkcji. Znowelizowana pod koniec 2008 r. ustawa o ochronie gruntów rolnych i leśnych zliberalizowała dotychczasowe przepisy, wyłączając użytki rolne położone w granicach administracyjnych miast spod działania ustawy. Równocześnie ograniczono przypadki konieczności uzyskania zgody wyższych organów na przeznaczenie w MPZP gruntów na cele inwestycyjne. W artykule przedstawiono: organy wydające zgodę na zmianę przeznaczenia gruntów w planie miejscowym, zmiany w zakresie rodzajów użytków wymagających decyzji o wyłączeniu oraz zmiany w zakresie kompetencji organów i możliwości zmniejszenia opłat za wyłączenie gruntów z produkcji rolnej i leśnej na przestrzeni ostatnich 15 lat.

Wydobywanie węgla brunatnego metodą odkrywkową wymaga zajmowania gruntów rolnych i leśnych. Odkrywkowa eksploatacja węgla powoduje likwidację dotychczasowej infrastruktury oraz przekształcenia środowiska naturalnego. Zakład górniczy jest zobowiązany do przestrzegania wielu przepisów z zakresu ochrony środowiska. Przekształcone grunty wymagają rekultywacji. Proces ten pozwala na przywrócenie tym gruntom wartości pożytkowej oraz ich właściwego zagospodarowania.

Lignite extraction in open-cast way imposes the requirement of careing a large surface area form mining and forestry usage. Extraction activities lead to changes in the natural environment and infrastructure. The KWB Konin lignite mine enterprise has to obey regulation concerning protection of the environment. After the end of mining operations the dumping areas are prepared for future agricultural or forestry usage.
