Performing independent technical functions in the construction industry requires meeting certain conditions specified, inter alia, in the Building Law Act. From August 1, 2022, decisions on entry in the register kept by the General Inspectorate of Building Supervision are no longer issued.

Celem artykułu jest przedstawienie problemów związanych z uzyskiwaniem uprawnień budowlanych. Odniesiono się do stanu prawnego od okresu międzywojennego do dnia dzisiejszego i pokazano, jak każda kolejna zmiana obniżała wymagania stawiane osobom ubiegającym się o uprawnienia budowlane. Ciągłe zmiany utrudniają stabilizację w zakresie zdobywania odpowiedniej praktyki zawodowej, przygotowania do egzaminu i jego zdawania. Przewidywane kolejne zmiany w przepisach prawnych nie wpłyną na poprawę stabilizacji w tym przedmiocie. W artykule starano się wyraźnie uzasadnić celowość i problematykę uprawnień budowlanych w Polsce, a w procesie stanowienia nowego prawa budowlanego, zwrócenie szczególnej uwagi na kwalifikacje osób pełniących samodzielne funkcje techniczne i na postępowanie kwalifikacyjne obarczone często niewłaściwą postawą kandydatów ubiegających się o uzyskanie uprawnień budowlanych.

The aim of this article is to present problems regarding the obtainment of construction licenses. References have been made to legislation from the inter-war period up to today, and it has been demonstrated how each new change has lowered the requirements to obtain a construction license. Continuous changes hinder stabilisation in the scope of obtaining proper professional practice, preparation for the exam, and passing the exam. The projected new changes in the law will not improve stabilisation in this matter. The aim of the article has been to clearly justify the purposefulness and present the issue concerning construction licenses in Poland, as well as, in the process of law-making, to pay particular attention to qualifications of individuals performing independent technical functions and to the qualification process which often involves improper behaviour of candidates applying for construction licenses.

Celem niniejszego artykułu jest przybliżenie określenia pojęcia nadzoru inwestorskiego oraz wzajemnych zależności z inspektorem nadzoru inwestorskiego określonym w prawie budowlanym. Przedstawiono status prawny inspektorów nadzoru (w tym inspektorów branżowych) wynikający zarówno z obowiązujących przepisów, jak i innych uwarunkowań. Omówiono także uregulowania dotyczące określenia inwestora zastępczego.

The article looks at the concept of investor supervision and mutual dependence of the investor's supervision inspector specified in the construction law as well as at the legal status of inspectors (including industry inspectors) resulting from both the applicable regulations and other conditions. The article overviews the regulations concerning a substitute investor.

Przepisy z lutego 2015 wprowadziły instytucję zgłoszenia inwestycji budowlanej z projektem, która ma być formą pośrednią pomiędzy pozwoleniem na budowę a zgłoszeniem. Mankamentem nowej procedury jest brak ochrony inwestora, nie ma gwarancji nabytych w drodze decyzji praw i obowiązków oraz brak jest ochrony przed nadmierną ingerencją władzy publicznej.

The February 2015 regulations require that a construction investment that is in line with the building project should be notified. It is a compromise between a building permit and a building notification. A minus of the new procedure is that an investor is not protected, that there are no acquired guarantees, and that there is no protection against excessive involvement of the public authority.

Niniejszy artykuł poświęcony został zagadnieniu dotyczącym wyjątku od zasady obowiązkowej kontroli obiektu budowlanego, o której mowa w art. 59a ustawy z dnia 7 lipca 1994 r. Prawo budowlane. Czytając obecnie obowiązującą ustawę Prawo budowlane nie można wysnuć wniosku o odstępstwie od obowiązku przeprowadzenia takiej kontroli. Wyjątek ten dostrzegany jest dopiero po analizie przepisów, którymi dokonano nowelizacji ustawy Prawo budowlane. Przedmiotem niniejszego opracowania będzie wskazanie sytuacji, w których nie mają zastosowania przepisy o obowiązkowej kontroli wybudowanego obiektu budowlanego.

The following paper focuses on issues connected with the exception to the rule of mandatory inspection of a finished building structure, referred to in the Act of July 7, 1994, Art. 59(a) (Construction Law). By analyzing the Act of the Construction Law which is currently in force, a conclusion can be drawn, that such exception to the rule of mandatory inspection of a finished building structure cannot be applied. Only after analyzing the amended provisions for the Construction Law does it become clear that this is, in fact, possible. The following paper aims at listing circumstances in which the provisions of the Construction Law on mandatory inspection of a finished building structure cannot be applied.
