The main premise of public procurement contracts being granted should be that the employer initiates the tender procedure only with the aim to award a contract and to achieve the objective. It should be, therefore, kept in mind that the employer should take every effort to meet the objective in cooperation with the contractor. On the one hand, the contractors may not be granted a power to impose on the employers a particular method to specify their needs and the way to meet those in the terms of reference, on the other hand, the employers should be refused the right to specify their requirements in the terms of reference at their sole discretion, which might lead to hindering competition to the extent exceeding the employer's needs.

The Ordering Party, applying in the contract concerning public procurements the FIDIC contractual terms, should thoroughly analyse the clause concerning the Engineer included in the general Terms of the contract and amend (correct) all inconsistencies according to the Public procurement law regulations, Civil code, Construction law and other regulations applicable to the public procurement. The Ordering Party should also consider the principles of social symbiosis and set customs (art. 353 1 of the Civil code) and then develop and implement to the concluded contract the special clauses considerations which shall eliminate such inconsistencies.

The article presents the rights and responsibilities of the Contract Engineer, as well as their manner of conduct, as referred to in public procurement procedures, based on the FIDIC contract conditions. The author presents, in detail, the scope of the work and responsibility of the Engineer, who is expected to run an entire building project in a professional manner. Taking on the role of the Contract Engineer requires an excellent knowledge of the building industry, in its broadest meaning, as well as knowledge of international procedures for investment completion, economics and law. The FIDIC procedures provide no such thing as a universal model of project management, since the participation of the Engineer is not identical in every project. It is certain, though, that the bigger the project, the more comprehensive approach it requires of the Engineer.
