W artykule przedstawiono postępowanie dotyczące wydania decyzji o środowiskowych uwarunkowaniach dla przedsięwzięć polegających na wydobywaniu kopalin ze złóż – uzyskiwanej przed koncesją udzielaną na podstawie ustawy – Prawo geologiczne i górnicze. Wskazano organy właściwe do jej wydania i uczestników biorących udział w tym postępowaniu (strony, społeczeństwo, organy opiniujące). Omówiono także udział organizacji społecznej i uprawnienia organizacji ekologicznej oraz wskazano prawne wymagania decyzji o środowiskowych uwarunkowaniach.

The licence for mining mineral deposits shall be issued after obtaining the environmental permits for the implementation of this undertaking. The procedure related to issuing this decision is initiated at the entrepreneur’s request accompanied by a project information sheet of the undertaking or an environmental impact statement. The provisions of Law determine the scope of information that should be included in these documents [9]. From 1st January 2015 the Regional Director for Environmental Protection is the competent body to issue decisions on the environmental permits for undertakings related to mining of mineral deposits covered by the mining ownership of the State Treasury (except for saline waters and healing and thermal waters). Depending on the type of undertaking, under Regulation [1], the adoption of the environmental permits may involve the need to conduct the environmental impact assessment. At that time, the parties, the society and ecological and social organisations participate in the proceedings before adopting the environmental permits. Legal requirements concerning environmental permits are determined by laws [2, 9]. The environmental permit is enclosed to the application for the licence to extract minerals.
