Celem artykułu jest identyfikacja i ocena wybranych systemowych rozwiązań odnoszących się do militaryzacji w kontekście przepisów ustawy o obronie Ojczyzny. W artykule przedstawiono problematykę militaryzacji z uwzględnieniem wieloelementowego charakteru państwa. W pierwszej części autorzy przedstawiają kwestię uwarunkowań prawnych odnoszących się do militaryzacji oraz definiowania zadań szczególnie ważnych dla bezpieczeństwa lub obronności państwa uzasadniających wpis do wykazu jednostek przewidzianych do militaryzacji. W części drugiej artykułu przedstawiono rozważania w odniesieniu do czynności organu wnioskującego o objęcie militaryzacją, organu, który objął jednostkę przygotowaniami do militaryzacji, kierownika jednostki przewidzianej do militaryzacji i kierownika jednostki zmilitaryzowanej. Efektem podjętego tematu są wnioski i postulaty dotyczące sposobu i trybu ustalania jednostek przewidzianych do militaryzacji oraz przedsięwzięć planistycznych i organizacyjno-mobilizacyjnych organów biorących udział w procesie przygotowania do objęcia militaryzacją jak i również po zmilitaryzowaniu. Materiałem źródłowym przedstawionych treści są akty prawa powszechnie obowiązującego oraz powszechnie dostępne inne dokumenty normatywne i opracowania naukowe.

The aim of the article is to identify and evaluate selected systemic solutions relating to militarization in the context of the provisions of the Homeland Defense Act. The article presents the issue of militarization taking into account the multi-element nature of the state. In the first part, the authors present the issue of legal conditions relating to militarization and to definition of tasks of particular importance for the security or defense of the state, justifying entry in the list of units to be militarized. The second part of the article presents considerations in relation to the activities of the authority applying for militarization, the authority that covered the unit with preparations for militarization, the head of the unit intended for militarization and the head of the militarized unit. The result of the discussed topic are conclusions and postulates regarding the method and mode of determining the units to be militarized and planning and organizational-mobilization projects of bodies involved in the process of preparation for militarization as well as after militarization. Generally applicable law acts and publicly available normative documents and scientific studies is the source material of the presented content.

W artykule przedstawiono problematykę dotyczącą kompetencji Ministra Rolnictwa i Rozwoju Wsi w obszarze obronności państwa. Autorzy artykułu przedstawili rozważania oraz wyniki przeprowadzonych w 2020 roku badań dotyczących kompetencji Ministra Rolnictwa i Rozwoju Wsi i realizacji przypisanych zadań obronnych do działów administracji rynki rolne, rolnictwo i rozwój wsi oraz urzędu obsługującego Ministra – Ministerstwa Rolnictwa i Rozwoju Wsi. Prezentowany materiał nie zawiera informacji niejawnych, a materiałem źródłowym przedstawionych treści stanowią akty prawa wewnętrznego Ministra Rolnictwa i Rozwoju Wsi oraz dokumenty normatywne i opracowania zwarte. Efektem podjętego tematu są wnioski i postulaty dotyczące aktualnego stanu diagnozowanej problematyki i postulowanych kierunków zmian.

The article presents the issues related to the competences of the Minister of Agriculture and Rural Development in the area of state defense. The authors of the article presented the considerations and results of the research carried out in 2020 on the competences of the Minister of Agriculture and Rural Development and the implementation of the assigned defense tasks to the administration departments of agricultural markets, agriculture and rural development, and the office supporting the Minister - the Ministry of Agriculture and Rural Development. The presented material does not contain classified information, and the source material of the presented content are acts of the internal law of the Minister of Agriculture and Rural Development, as well as normative documents and compact studies. The effect of the undertaken topic are conclusions and postulates concerning the current state of the diagnosed issues and the proposed directions of changes.
