Opis kryteriów wyboru oferty najkorzystniejszej w zamówieniach publicznych obok opisu przedmiotu zamówienia i warunków udziału w postępowaniu jest jednym z najistotniejszych elementów specyfikacji istotnych warunków zamówienia. W artykule dokonano analizy przepisów prawa krajowego i unijnego oraz orzecznictwa dotyczącego opisywania i oceniania pozacenowych kryteriów oceny ofert. Zasadniczym celem autorki było wskazanie w artykule najczęściej popełnianych błędów zamawiających w tym zakresie oraz sformułowanie zaleceń dla zamawiających zobligowanych do stosowania przepisów ustawy Pzp.

The description of the criteria for selecting the most advantageous tender in public procurement, along with the description of the subject of the order and the conditions for participation in the procedure, is one of the most important elements of the specification of essential terms of the contract. The article analyzes the provisions of national and EU law as well as the case law concerning describing and assessing non-price criteria for the evaluation of offers. The main goal of the author was to indicate in the article the most common mistakes made by the ordering parties in this respect and to formulate recommendations for the ordering parties obliged to apply the provisions of the PPL Act.

W artykule omówiono definicje robót budowlanych i obiektu budowlanego oraz zasady określania zakresu i wartości zamówienia publicznego na roboty budowlane. Celem autorki było udzielenie odpowiedzi m.in. na pytania: Kiedy dochodzi do naruszenia art. 5b i art. 32 ust. 2 ustawy PZP? Czy zamawiający jest zobligowany podzielić zamówienie na części w celu umożliwienia udziału w postępowaniu małym i średnim przedsiębiorstwom (MSP)?

The article discusses the definitions of construction works and of a building construction as well as the rules for determining the scope and value of a public procurement for construction works. The author's goal was to answer the following questions: When is there a violation of art. 5b and art. 32 para. 2 PPL Acts? Is the contracting authority obliged to divide the order into parts in order to allow small and medium-sized enterprises (SMEs) to participate in the proceedings?

W artykule wskazano najczęściej popełniane nieprawidłowości w zakresie opisywania wyrobów w dokumentacji projektowej i specyfikacjach technicznych wykonania oraz odbioru robót budowlanych realizowanych w formule "zbuduj". Szczegółowej analizie poddano ugruntowane orzecznictwo Krajowej Izby Odwoławczej i sądów powszechnych. Autorka sformułuje zalecenia dla zamawiających, których wdrożenie może zminimalizować ilość zapytań do treści specyfikacji istotnych warunków zamówienia, postępowań odwoławczych, sądowych i dyscyplinarnych, a także korekt finansowych nakładanych na wydatki ponoszone z funduszy strukturalnych i Funduszu Spójności.

The article identifies the most common irregularities in the description of products in project documentation and technical specifications for the execution and acceptance of construction works carried out in the "build" formula. The well-established case law of the National Chamber of Appeals and common courts has been thoroughly analyzed. The author formulates recommendations for ordering entities, implementation of which may minimize the number of inquiries to the contents of the tender specifications, appeal proceedings, court and disciplinary proceedings, as well as financial corrections imposed on expenses incurred from structural funds and the Cohesion Fund.

Przebieg i udokumentowanie odbioru robót budowlanych oraz dochodzenie usunięcia ujawnionych w trakcie odbiorów robót budowlanych wad fizycznych mają istotny wpływ na stan techniczny, użytkowy i estetyczny obiektu budowlanego. W artykule udzielono odpowiedzi na kluczowe pytania dotyczące przebiegu procedury odbiorowej, w tym - czy inwestor może odmówić odebrania wadliwych robót budowlanych i zapłaty za ich wykonanie? Zasadniczym celem autorki było dokonanie rzetelnej i kompleksowej interpretacji przepisów Prawa budowlanego i Kodeksu cywilnego w oparciu o orzecznictwo sądów powszechnych oraz doświadczenie autorki będącej biegłym sądowym z zakresu budownictwa w specjalnościach: kierowanie procesem inwestycyjnym i eksploatacja obiektów budowlanych.

The course and documentation of the acceptance of construction work and the investigation of the removal of physical defects disclosed during the acceptance of construction work hugely influence the technical, usable and aesthetic condition of a building. The article answers key questions concerning the course of the acceptance procedure, including - can an investor refuse to receive defective construction work and pay for its execution? The main aim of the author was to make a thorough and comprehensive interpretation of the Building Code and the Civil Code based on the jurisprudence of common courts and the experience of the author who is a forensic expert in the field of construction in the following specializations: management of the investment process and operation of buildings.

W artykule wskazano i przeanalizowano najczęściej występujące nieprawidłowości i uchybienia w zakresie formułowania postanowień umów o roboty budowlane przez podmioty zobligowane do stosowania ustawy Prawo zamówień publicznych. Celem autorki było sformułowanie zaleceń, których wdrożenie umożliwi zminimalizowanie liczby pytań wykonawców do treści specyfikacji istotnych warunków zamówienia (SIWZ), postępowań odwoławczych i sądowych oraz usprawni realizację i rozliczanie przedsięwzięć budowlanych. Autorka wskazała elementy, które powinna zawierać umowa o roboty budowlane polegające na budowie obiektu budowlanego w formule "zbuduj", aby należycie zabezpieczała interesy zamawiającego (inwestora), generalnego wykonawcy, podwykonawców i dalszych podwykonawców robót budowlanych.

The article identifies and analyzes the most frequently occurring irregularities and deficiencies in the formulation of provisions of building work contracts by entities obliged to apply the Public Procurement Law Act. The aim of the author was to formulate recommendations, the implementation of which will allow to minimize the number of questions of contractors to the content of the terms of reference (SIWZ),to appeal and court proceedings, and to improve the realization and settlement of construction projects. The author pointed out the elements which should include the construction contract consisting in erecting a building in the formula "build" to property protect the interests of the contracting authority (investor), general contractor, subcontractors and other subcontractors of building work.

W artykule omówiono typowe uszkodzenia stalowych obiektów mostowych, w szczególności obiektów zlokalizowanych na terenach silnie zurbanizowanych. Obiekty te są szczególnie narażone na występowanie wielu czynników przyspieszających proces ich degradacji, takich jak: zanieczyszczenie powietrza, prądy błądzące oraz duża ilość cykli obciążeń. Zasadniczym celem autorów było sformułowanie ogólnych zaleceń, których wdrożenie w sposób bezpośredni lub pośredni może przyczynić się do spowolnienia procesu degradacji stalowych obiektów mostowych. Dodatkowo zalecenia te mogą wpływać na zwiększenie bezpieczeństwa i komfortu użytkowników dróg oraz wydłużyć czas bezpiecznej eksploatacji tych obiektów. Zalecenia obejmujące fazę projektowania, budowy i eksploatacji obiektów mostowych sformułowano na podstawie wieloletnich doświadczeń nabytych podczas przeglądów drogowych i kolejowych obiektów mostowych o konstrukcji stalowej.

The paper describes typical damage of steel bridge structures and in particular structures located in highly urbanized areas. These objects are especially prone to a number of factors that accelerate their process of degradation, such as air pollution, stray currents or a large number of load cycles. The main aim of the authors was to formulate general recommendations, the implementation of which may contribute, directly or indirectly, to slowing the degradation process of steel bridge structures. In addition, these recommendations may increase the safety and comfort of road users and extend the safe operation of these structures. Recommendations that cover the phases of the design, construction and operation of bridge structures were formulated on the basis of many years of experience, which was acquired during inspections of steel road and rail bridge structures.
