Utilization of companies trademarks and industrial designs in the market strengthens activities of selected companies. Authors of the paper analyse the significance of a trademark and industrial design for the level of the company's industrial property safety. The threats resulting from the lack of trademark registration were identified and analysed, and selected cases from the case law in the field of trademark protection were reviewed to indicate the scope of protection and safety of products placed on the market.

Znaki towarowe stanowią współcześnie jedną z kategorii praw własności intelektualnej. Podstawową funkcją znaków towarowych jest odróżnianie towarów lub usług jednego przedsiębiorstwa od towarów lub usług innych przedsiębiorstw. Ustawowa definicja nie wyczerpuje jednak wszystkich zastosowań współczesnych znaków towarowych. W praktyce znaki towarowe pełnią także inne, ukryte funkcje, które nie wynikają wprost z brzmienia obowiązujących przepisów. Celem artykułu jest określenie ukrytych funkcji znaków towarowych oraz prawna ocena ich dopuszczalności.

Trademarks are one of categories of intellectual property law in our times. The basic function of trademarks is to distinguish products and services of one enterprise from products and services of other enterprises. However legal definition of trademarks is not using up all applications of contemporary trademarks. In practice trademarks are also performing other “hidden” functions which is not present in regulations. Determining of “hidden” functions of trademarks and the legal evaluation of their admissibility are purpose of the article.

Znaki towarowe stanowią współcześnie nieodzowny element nowoczesnych strategii konkurencyjności przedsiębiorstw. Są one istotne z punktu widzenia promocji i tworzenia wizerunku przedsiębiorstwa na rynku. Dlatego też kluczową kwestią jest efektywne zabezpieczenie znaków towarowych przed działaniami nieuczciwej konkurencji. Współcześnie dostępnych jest kilka alternatywnych systemów ochrony znaków towarowych. Artykuł określa kierunki rozwoju ww. systemów. Celem opracowania jest także określenie przyczyn rozwoju jednych systemów ochrony i regresu pozostałych.

Trademarks are crucial element of modern strategies of competitiveness of businesses in our times. It’s very important for promotion and image on the market. That’s why problem of protecting trademarks against unfair competition is a crucial issue. There are a few alternative protection systems of trademarks in our times. The article presents directions of the development of alternative protection systems of trademarks. The main goal is to find and present the causes of development protection systems of trademarks.

W artykule podjęto problem rozpoznawania znaków drukowanych. Do realizacji recepcji użyto odwzorowania przekształcającego zbiór funkcji całkowalnych dwóch zmiennych o ograniczonej dziedzinie i wartościach w przestrzeń będącą iloczynem kartezjańskim k zbiorów funkcji jednej zmiennej o ograniczonej dziedzinie i wartościach. Opisano wyniki działania systemu zrealizowanego na podstawie zdefiniowanej w ten sposób recepcji.

In this article there was undertaken the problem of recognizing printed signs. To realization of reception there was used a function transforming a collection of integrate dfunctions of two variables with a limited domain andvalues in space that is a Cartesian product of k collections of functions of one variable with a limited domain and values. There were described the results of the activity of a system which was constructed on the basis of defined in this way reception.
