Zasięg prawa własności określany przez współrzędne położenia punktu granicznego działki ewidencyjnej jest zrozumiały dla systemu informatycznego przechowującego obiekty przestrzenne. Zasięg prawa własności identyfikowany jest przez właściciela nieruchomości przede wszystkim poprzez kamienie graniczne (i inne znaki graniczne) zastabilizowane na gruncie. W pracach geodezyjnych związanych z granicami, czynność stabilizacji często uzależniona jest od przepisu prawnego, który jednoznacznie ten moment definiuje, w zależności od wykonywanej pracy geodezyjnej opisanej w konkretnej procedurze związanej z granicami. W artykule przeanalizowano uwarunkowania prawne w zakresie znaków granicznych i ich ochrony, stabilizacji, moment determinowanej przez przepisy prawa stabilizacji oraz konieczność uregulowań prawnych w wymienionych aspektach. Poruszono problem stabilizacji granic działki ewidencyjnej, istniejącej i nowo wydzielanej w zależności od czynności geodezyjnej związanej z granicami oraz jakości istniejących danych geodezyjnych.

Extension of the ownership rights determined by coordinates of a boundary point of a cadastral parcel is understandable for an information system, which stores spatial objects. Extension of the ownership rights is identified by an owner of a real property, first of all, by means of boundary stones (and other boundary marks) stabilised on the ground. During geodetic surveys connected with boundaries, stabilisation works often depend on a legal regulation which explicitly defines that moment, depending on geodetic works described in a particular procedure related to boundaries. The paper presents the analysis of legal regulations concerning boundary marks and their protection, stabilisation and the moment of stabilisation determined by legal regulations, as well as the necessity to introduce legal regulations related to discussed aspects. The issues of stabilisation of boundaries of existing and newly delineated cadastral parcels, depending on geodetic operations related to boundaries, as well the quality of existing surveying data are also discussed.

Prawo geodezyjne i kartograficzne obok postępowania w sprawie o rozgraniczenie nieruchomości reguluje także instytucję wznowienia znaków graficznych. Przepisy w tym zakresie nie są jednak jednoznaczne. Mówią o technicznym (poza postępowaniem administracyjnym) wyznaczeniu znaków granicznych, jedynie pośrednio odnosząc się do rozgraniczenia nieruchomości. Przewidują też np. możliwość skierowania sprawy do sądu, nie określają jednak kryteriów rozpoznania sprawy, jak i jej przedmiotu. Regulacja ta wymaga legislacyjnego doprecyzowania.

Besides procedures concerning delineation of real estates, the geodetic and cartographic law also regulates the procedures of restoration of border marks. However, rules concerning those issues are not explicit. They describe technical determination of border marks (apart from administrative procedures) and are indirectly related to delimitation of real estates. The also foresee the possibility to apply to courts, however those rules do not specify criteria of making the decision or criteria concerning the subject matter of procedures. Therefore those regulations should be formulated more precisely.
