Artykuł prezentuje normatywne wymagania infrastruktury informacyjno-komunikacyjnej, które zarazem tworzą standard jej bezpieczeństwa. Główny nurt rozważań koncentruje się wokół pojęcia normatywnych wymagań bezpieczeństwa infrastruktury oraz klasyfikacji i charakterystyki wymagań. Analiza obejmuje także zasady obowiązujące przy określaniu przez podmiot publiczny samych wymogów stosowanych dla infrastruktury i jej interoperacyjności, a także zasady stosowane już przy tworzeniu i modernizacji konkretnej infrastruktury informacyjno-komunikacyjnej.

The article presents the normative requirements of the information and communication infrastructure, which also form the standard of its security. Its main considerations focus on the concept of normative infrastructure security requirements as well as their classification and characteristics. The analysis also includes the rules applicable to the public entity's definition of the requirements applicable to infrastructure and its interoperability, as well as the principles already applied when creating and modernizing a specific information and communication infrastructure.

Praca zagłębia się w ostatnie orzecznictwo sądów administracyjnych kontrolujących decyzje o wpisie do rejestru zabytków. Analiza jest zogniskowana wokół zasad ogólnych ustanowionych w Kodeksie postępowania administracyjnego. W rozważaniach kluczową rolę przypisano prawu własności jako wartości o proweniencji konstytucyjnej. Implikacje prawne wynikające z tego punktu odniesienia zostały zbadane pod kątem postępowań administracyjnych dotyczących rzeczonej wspomnianej decyzji. Podobnie zasada proporcjonalności została skonfrontowana z obowiązkami i kompetencjami wojewódzkiego konserwatora zabytków, albowiem ta zasada należy do zasad ogólnych KPA, choć jej sklasyfi kowanie jest oparte na poczynionej dedukcji z różnych przepisów Kodeksu.

The paper delves into the recent case-law of administrative courts reviewing decisions of entry into monuments’ registry. The analysis is focused on general rules laid down in the Code of Administrative Procedure. In the considerations a pivotal role has been ascribed to property law as constitutionally rooted value. Legal implications stemming from this point of reference have been studied in terms of the administrative proceeding regarding the decision at issue. Likewise principle of proportionality has been confronted with obligations and competences vested with a voivodeship conservator of monuments since this principle belongs to general principles of the Code although its classification is relied upon deduction from various Code’s provisions.
