The article presents the initiatives, that the European Commission has undertaken with regard to the European defence sector, which traditionally was in the member states domain. The article describes the process in which the Commission strengthens its competences on various aspects of internal market that influence defence enterprises and the way that member States procure military systems. At the same time, the existing prerogatives concerning the essential security interests enshrined in the EU Treaties received a new interpretation, which stimulates integration process of defence sector leading to an increase in EU competitiveness.

Po wejściu w życie dyrektywy obronnej zmieniły się zasady pozyskiwania sprzętu wojskowego w krajach Unii Europejskiej. W artykule przedstawiono zasady, podstawy prawne, sposób planowania, organizację oraz procedury pozyskiwania uzbrojenia w Republice Francuskiej. Proces ten realizowany jest przez Główne Przedstawicielstwo do Spraw Uzbrojenia. Postępowania o udzielenia zamówienia na sprzęt wojskowy przeprowadzane są na podstawie powszechnie obowiązujących regulacji prawnych określonych w Kodeksie Zamówień Publicznych (Code des Marches Publics) oraz Dekrecie Obronnym (dekret nr 2004-16 z 17 lipca 2004 r.). Proces pozyskiwania uzbrojenia w Republice Francuskiej składa się z czterech faz: wstępnej, projektowania, realizacyjnej i użytkowania. Każda faza kończy się wypracowaniem dokumentu, który będzie podstawą rozpoczęcia fazy następnej.

The rules of acquiring of military equipment among the EU Members have changed after entering into force of the Directive 2009/81/EC of the European Parliament and of the Council of 13 July 2009 on the coordination of procedures for the award of certain works contracts, supply contracts and service contracts by contracting authorities or entities in the fields of defence and security, and amending Directives 2004/17/EC and 2004/18/EC. This article is to present the rules, legal basis, methods of planning, organization and procedures of acquiring of armament in the Republic of France. The main actor in this process is the General Delegate for Armament - DGA. Armaments procurements are proceeded on the basis of common legal rules given in the Code of public procurement (Code des Marches Publics) and the Decree N° 2004-16 of July 17th 2004. The process of acquiring of military equipment in France is consisted of four phases: preliminary, designing, realization and utilization. Each phase is ended with elaboration of a document being the basis for initiation of next phase.

Po wejściu w życie dyrektywy obronnej zmieniły się zasady pozyskiwania sprzętu wojskowego dla Sił Zbrojnych Rzeczypospolitej Polskiej. Obecnie sprzęt wojskowy pozyskuje się na podstawie znowelizowanych przepisów ustawy - Prawo zamówień publicznych oraz decyzji Ministra Obrony Narodowej w sprawie zasad i trybu udzielania w resorcie obrony narodowej zamówień w dziedzinie obronności i bezpieczeństwa państwa przypadku, gdy wymaga tego podstawowy interes bezpieczeństwa państwa. W artykule przedstawiono zasady, procedury oraz przesłanki unieważniania postępowań o udzielanie zamówień na sprzęt wojskowych dla Sił Zbrojnych Rzeczypospolitej Polskiej, w przypadku gdy zamówienie jest zaklasyfikowane do kategorii "podstawowy interes bezpieczeństwa państwa". Sprzęt wojskowy pozyskiwany jest w tym przypadku w dwóch trybach: zamówienia otwartego i negocjacji w trybie zamkniętym.

After the entry into force of the defense Directive the rules of acquiring military no for the Polish Armed Forces have changed. Currently, military equipment is acquired on of the amended provisions of the Act - Public Procurement Law and The decision of the Minister of National Defence on the principles and procedures for the award of the procurement in the field of defense and security in Ministry of Defence in case, when is required by the fundamental it of national security. The article presents the principles, procedures and conditions for revocation proceedings for the award of contracts for military equipment for the Polish Armed Forces when an order is classified in the category of "essential security interest of the state". In this case the military equipment is obtained in two procedures: open tendering and negotiations in restricted tendering.
