Treść artykułu jest próbą analizy aktualnego stanu dotyczącego problemu zabezpieczenia niezagospodarowanych złóż kopalin górnictwa odkrywkowego w Polsce. Szczególny nacisk autorzy położyli na nowe rozwiązania prawne jakie znalazły się w ustawie z dnia 9 czerwca 2011 r. – Prawo geologiczne i górnicze, próbując jednocześnie ocenić skuteczność przyjętych przepisów. W materiale znalazły się również liczne wzmianki dotyczące proponowanych na przestrzeni minionych lat rozwiązań w tym zakresie oraz propozycje nowych. Artykuł wskazał jednoznacznie, że instytucja „zabezpieczenia złóż” winna być bardziej skuteczna, bo tylko taka może gwarantować dalszy rozwój górnictwa odkrywkowego w Polsce.

The article is an attempt of analysis of the current state concerning the protection of non-developed mineral deposits of surface mining in Poland. Particular pressure put the authors on new legal regulations in the act of 9 June 2011 – Geological and mining law, trying simultaneously to assess the efficiency of adopted regulations. The material contains also numerous references concerning the solutions proposed during the past years relating to this scope and proposals of new solutions. The article has indicated univocally that the institution “deposit protection” should be more efficient, because only such one can guarantee the further development of surface mining in Poland.

Artykuł ma na celu sygnalizację wybranych problemów dotyczących zabezpieczania złóż kopalin węgla brunatnego dla odkrywkowej działalności górniczej. Przedstawione problemy koncentrowały się na niedostatkach w obowiązujących regulacjach prawnych i niewłaściwych praktykach, jakie są stosowane. Podjęto próbę wskazania innych rozwiązań bardziej skutecznych w zakresie ochrony obszarów szczególnych, jakie są regulowane w ustawach odrębnych. Podano je jako hipotetyczny sposób na rozwiązanie problemu zabezpieczania złóż kopalin węgla brunatnego. Artykuł stara się wyjaśnić jakie sytuacje zdarzające się w praktyce minimalizują możliwość prowadzenia odkrywkowej działalności górniczej. Końcowe tezy artykułu to symptomy kierunków zmian, jakie coraz częściej się pojawiają w celu umożliwienia udostępnienia złóż węgla brunatnego.

The article's goal is to indicate the chosen problems concerning security of brown coal deposits for opencast mining activity. These problems are particularly associated with the procedure of spatial planning on commune's level and with the assurance that the regions which have mineral deposits will be secured as the result of this planning. Furthermore the article brings up the case of deposits' ownership which - unfortunately - in Polish law is determined by the method of exploitation. Significant part of the article is dedicated to the issue of showing the position of opencast brown coal exploitation as a public goal in the understanding of estate management act. The presented problems focus on the imperfections in current law regulations and improper practices that are in use. An attempt to show more efficient solutions concerning the particular areas was made. The proposed solutions are based on such special areas of protection as Nature 2000 areas which are very efficiently protected by the nature protection act or agricultural and forest areas protected by the act about the protection of agricultural and forest areas. These solutions are shown as a hypothetical way to solve the problem of securing brown coal deposits. The article tries to explain what kind of situations that happen in practice minimize the possibility of running an opencast mining activity. The closing thesis shows the symptoms of changes direction. Because of the excess of bureaucratic procedures (namely numerous agreements, opinions) these changes are becoming necessary to enable the procedure of making brown coal deposits accessible and to run accompanying investments.
