Running a business is inherently associated with economic risk. It is connected with the lack of certainty concerning the solvency of the counterparty and a possibility of a dispute arising out of the contract Business risk is especially evident in the construction industry, where many companies cease to exist because of their counterparties insolvency or due to inability to enforce the debt. Contractors are in a worse situation than the investor, becaue they receive their remuneration only after completing the work. For this reason, due care for proper protection of claims arising from concluded contracts should be one of the basic aims of each entity performing construction works.
