Przedmiotem opracowania jest ustawowe prawo do odstąpienia od tzw. nowej umowy deweloperskiej, która została redefiniowana na mocy nowej ustawy deweloperskiej obowiązującej od dnia 1 lipca 2021 r. W artykule udzielono odpowiedzi na kluczowe pytania dotyczące zmian w zakresie ustawowych uprawnień nabywcy i dewelopera do odstąpienia od umowy deweloperskiej. Omówione zostały nowe przepisy regulujące stosunki między deweloperem, a nabywcą lokalu mieszkalnego lub domu jednorodzinnego i wpływ tych zmian na rynek nieruchomości. Zasadniczym celem autorki było kompleksowe omówienie kluczowych różnic w przesłankach i formie odstąpienia od umowy deweloperskiej, zarówno gdy odstępuje deweloper jak i nabywca.

The subject of the study is the statutory right to withdraw from the so-called a new development agreement, which was re-defined under the new developer law applicable from 1 July 2021. The article answers the key questions regarding changes in the statutory rights of the buyer and the developer to withdraw from the development contract. New rules governing the relations between the developer and the buyer of a flat and also the impact of these changes on the real estate market were discussed. The main aim of the author was comprehensive discussion of the key differences in the premises and form of withdrawal from the development contract, both when the developer and the buyer withdraw.
