Prawo Unii Europejskiej od blisko dwóch dekad podejmuje problem elektronicznych systemów poboru opłat za użytkowanie infrastruktury drogowej. W oficjalnych dokumentach UE podkreśla się potrzebę utworzenia spójnego i interoperacyjnego systemu ETC dla krajów członkowskich w postaci usługi EETS. Co istotne, prawo UE reguluje jedynie funkcjonowanie omawianych systemów w odniesieniu do transportu ciężarowego. Pojazdy lekkie, do których w większości zalicza się samochody osobowe, nie stanowią przedmiotu unormowań europejskich. W Polsce w roku 2011 utworzono system viaTOLL, który również przystosowany jest przede wszystkim do transportu ciężarowego. Od 2012 roku, na zasadzie dobrowolności, włączeni do niego zostali kierowcy samochodów osobowych (viaAUTO). Funkcjonowanie tej usługi nie zostało jednak uregulowane w prawie polskim. Systemy ETC działające w innych krajach członkowskich, które stanowią materiał porównawczy dla Polski wdrażane były w dużych odstępach czasu i w oparciu o różne technologie. Choć pomiędzy nimi można zidentyfikować liczne podobieństwa, nie są one ze sobą kompatybilne. W wielu krajach UE pobór opłat za użytkowanie dróg odbywa się w oparciu o inne systemy – manualne czy winietowe.

For nearly two decades the European law has dealt with the problem of electronic toll collection systems. Official documents of the EU stress the need to create a coherent and interoperable ETC system for member states - EETS. However EU law only regulates the functioning of the systems concerning cargo transport. Light vehicles, which mostly include passenger cars, are not subject of European regulations. In 2011 Poland created the viaTOLL system also dedicated to cargo transport. Since 2012 also passenger car drivers have the possibility to join this system (viaAUTO), it is not however regulated in the Polish law. ETC systems operating in other EU member states, were not implemented at the same time and are based on different technologies. Although one can identify numerous similarities between them, they are not compatible. Moreover in many EU countries the use of toll roads is based on other payment methods – manual tolling or vignette.

Changes in the act on Public Roads and some other acts are intended to implement in Polish law the provisions of European Parliament Directive 2006/38/EC on fee collection for use of some types of infrastructure by heavy vehicles. According to the bill submitted to the Polish Parliament (Sejm) by the government, the vignette system was to cease to operate on 1st July 2008. After the works undertaken by Infrastructure Commission some changes was introduced to the bill to the act on public roads. The main changes concern maintain the vignettes up to the half of 2011 and introducing the electronic fee system from 1st July 2011, also rise the vignette charges to stabilise the NRF’s budget for next three years. The paper present the evolution of legislative path accompanied constructing motorways in Poland.
