Artykuł jest poświęcony omówieniu elementu procedury usunięcia pojazdu z drogi, którym jest powiadomienie jego właściciela o dokonaniu tej czynności. Autor wskazuje, że wszystkie zagadnienia z tym związane są uregulowane w art. 130a ustawy – Prawo o ruchu drogowym oraz w rozporządzeniu Ministra Spraw Wewnętrznych i Administracji z dnia 22 czerwca 2011 r. w sprawie usuwania pojazdów, których używanie może zagrażać bezpieczeństwu lub porządkowi ruchu drogowego albo utrudniających prowadzenie akcji ratowniczej. Wykazuje, że powiadomienie o usunięciu pojazdu z drogi jest niezbędnym elementem procedury, umożliwiającym wydanie pojazdu albo wystąpienie do sądu o orzeczenie jego przepadku na rzecz powiatu (Skarbu Państwa). Szczególną uwagę poświęca pojęciom „właściciel pojazdu” i „osoba dysponująca pojazdem”, ponieważ to tym podmiotom musi być doręczone powiadomienie.

The article discusses the specific element of the procedure of removing a vehicle from the road which lies in the notification about removing a vehicle from the road. All issues connected with this are regulated in the Article 130a of the Act on Road Traffic and Regulation of the Minister of Interior and Administration of 22 June 2011 on the removing of vehicles from the road whose use may jeopardize the safety or order of road traffic or hamper the conduct of rescue operation. Notification is an indispensable element of this procedure enabling the issuance of a vehicle or go to court to decree a judgement of confiscation of the vehicle for the benefit of the State Treasury. Particular attention is paid to the concepts of “vehicle owner” and “vehicle authorised user” because to these entities the notification must be delivered.

Artykuł jest poświęcony omówieniu jednego z elementów procedury usunięcia pojazdu z drogi, którym jest doręczenie powiadomienia o tym fakcie. Procedura ta jest uregulowana w art. 130a ustawy – Prawo o ruchu drogowym oraz w rozporządzeniu Ministra Spraw Wewnętrznych i Administracji z dnia 22 czerwca 2011 r. w sprawie usuwania pojazdów, których używanie może zagrażać bezpieczeństwu lub porządkowi ruchu drogowego albo utrudniających prowadzenie akcji ratowniczej. Powiadomienie o usunięciu pojazdu z drogi jest niezbędnym elementem tej procedury, umożliwiającym wydanie pojazdu właścicielowi albo wystąpienie do sądu o orzeczenie przepadku pojazdu na rzecz powiatu (Skarbu Państwa). Wspomniane rozporządzenie, w kwestii doręczenia powiadomienia odsyła do ustawy z dnia 14 czerwca 1960 r. Kodeks postępowania administracyjnego. Szczególną uwagę autor poświęca zagadnieniom związanym z podmiotem zobowiązanym do doręczenia powiadomienia, sposobami doręczeń oraz skutkiem, jaki wywołuje doręczenie powiadomienia.

The article discusses the specific element of the procedure of removing a vehicle from the road which is delivery of a notification about removing a vehicle from the road regulated in the Article 130a of the Law on Road Traffic and Regulation of the Minister of Interior and Administration of 22 June 2011 on the removing of vehicles from the road whose use may jeopardise the safety or order of road traffic or hamper the conduct of a rescue operation. Notification is an indispensable element of this procedure. It enables the issuance of a vehicle or going to court for decree a judgement of confiscation of a vehicle for the benefit of the county. Regulation of the Minister of Interior and Administration of 22 June 2011 in terms of the delivery of a notification refers to the Act of June 14, 1960 The Code of Administrative Procedure. Particular attention was paid to the issues related to the entity obliged to deliver the notification, the means of delivery and the legal effect caused by the delivery notification.

Artykuł jest poświęcony problematyce związanej z realizacją obowiązku z art. 78 ust. 4 ustawy – Prawo o ruchu drogowym, jak również z odpowiedzialnością, wynikającą z art. 96 § 3 Kodeksu wykroczeń, w przypadku niewypełnienia tego obowiązku przez zobowiązanego. Ustalono krąg podmiotów zobowiązanych na podstawie tych przepisów oraz podmiotów uprawnionych do żądania informacji o tym, komu właściciel lub posiadacz pojazdu powierzył pojazd do kierowania lub używania w oznaczonym czasie. Ponadto zwrócono uwagę na zagadnienia związane z zachowaniem się właściciela lub posiadacza pojazdu, który, nie realizując obowiązków wynikających z art. 78 ust. 4 ustawy – Prawo o ruchu drogowym, wypełnia znamiona wykroczenia z art. 96 § 3 k.w. oraz na okoliczności, które – mimo iż stanowiły przypadki niezastosowania się do normy wynikającej z art. 78 ust. 4 cyt. ustawy – nie mogły skutkować odpowiedzialnością za przedmiotowe wykroczenie.

This article is completely devoted to some problems connected with the implementation of the obligation included in article 78 sec. 4 Act of 20 June 1997 of the Law on Road Traffic, as well as the liability resulting from Art. 96 paragraph 3 of the Code of Offenses, in cases not – compliance by the obliged entity. A set of entities obliged under the aforementioned norms and entities authorized to request information from the owner or the holder of the vehicle about that who he has been assigned the vehicle to drive or use on time. In addition, special attention was paid to the issue of the behavior of the owner or the holder of a vehicle who, failing to comply with the obligations under Art. 78 sec. 4 Act of the Law on Road Traffic they fill the marks of the offense of Art. 96 paragraph 3 of the Code of Offenses and on circumstances which, even though they constituted cases of non-compliance with the standard resulting from Art. 78 sec. 4 Act of the Law on Road Traffic could not be responsible for the offense in question.
