Spatial development involves planning, organizing, and managing physical spaces in cities, regions, or countries, aiming to optimize efficiency, sustainability, and quality of life through land arrangement, resource allocation, and infrastructure management. This study examines spatial management in Poland, guided by the 2003 law on spatial planning and development, exploring its hierarchical structure ensuring spatial order and policy implementation. Recent legislative amendments on July 2023, are scrutinized, impacting spatial planning by emphasizing public participation and introducing tools like the municipal general plan and Urban Register. The study delves into the evolving process of issuing WZ Decisions and integrating public consultations. It assesses amendments' effects on stakeholder involvement and legal framework changes in practice. Public participation principles are analyzed, detailing stakeholder roles, engagement nature, and legal mechanisms in spatial planning processes. Furthermore, the study investigates the introduction of the general municipal plan, zoning categorization, and the new WZ Decisions' compliance procedure. The creation of the Urban Register is discussed, highlighting its functionalities and intended role as a comprehensive spatial planning and development information source. In summary, this study offers a comprehensive analysis of recent legislative changes in Poland's spatial planning and development, focusing on practical implications and the evolving landscape of public participation and spatial governance within the country.

W artykule przedstawiono postępowanie dotyczące wydania decyzji o środowiskowych uwarunkowaniach dla przedsięwzięć polegających na wydobywaniu kopalin ze złóż – uzyskiwanej przed koncesją udzielaną na podstawie ustawy – Prawo geologiczne i górnicze. Wskazano organy właściwe do jej wydania i uczestników biorących udział w tym postępowaniu (strony, społeczeństwo, organy opiniujące). Omówiono także udział organizacji społecznej i uprawnienia organizacji ekologicznej oraz wskazano prawne wymagania decyzji o środowiskowych uwarunkowaniach.

The licence for mining mineral deposits shall be issued after obtaining the environmental permits for the implementation of this undertaking. The procedure related to issuing this decision is initiated at the entrepreneur’s request accompanied by a project information sheet of the undertaking or an environmental impact statement. The provisions of Law determine the scope of information that should be included in these documents [9]. From 1st January 2015 the Regional Director for Environmental Protection is the competent body to issue decisions on the environmental permits for undertakings related to mining of mineral deposits covered by the mining ownership of the State Treasury (except for saline waters and healing and thermal waters). Depending on the type of undertaking, under Regulation [1], the adoption of the environmental permits may involve the need to conduct the environmental impact assessment. At that time, the parties, the society and ecological and social organisations participate in the proceedings before adopting the environmental permits. Legal requirements concerning environmental permits are determined by laws [2, 9]. The environmental permit is enclosed to the application for the licence to extract minerals.

Economic development is a long-term process, and faces the idea of sustainable development. Development of the infrastructure investments is one of the most important elements which determinate economic growth. The environmental impact assessment (EIA) gives the citizens opportunity of implementation of their sustainable solutions in the wider process of planning infrastructure investments. One of the basic part of the decision process is the environmental impact assessment which lead to the first „investment decision” ie.: the decisions on the environmental conditions. The environmental impact assessment for a project means the procedure of working out the best solutions for the proposed project, including in particular: the verification of the environmental impact report for the project, the acquisition of the opinions and approvals required by the Act of 3 October 2008 on the Provision of Information on the Environment and its Protection, Public Participation in Environmental Protection and Environmental Impact Assessments, ensuring the possibility of public participation in the procedure. This article is based on wide data bases of administration procedures and outlines the procedure for public participation in environmental impact assessment to emphasize its impact positive and negative on the development of infrastructure investments.

Przed zatwierdzeniem Planów Zarządzania Ryzykiem Powodziowym wymagane jest zapewnienie udziału społeczeństwa w procesie ich opracowywania. Podobnie jest w przypadku dokumentów stanowiących polityki, plany lub programy wyznaczające ramy dla przedsięwzięć mogących znacząco oddziaływać na środowisko lub których realizacja może spowodować znaczące oddziaływanie na obszar Natura 2000.

In Poland many authorities are responsible for flood risk management. For this reason as many as possible stakeholders should be involved in the production of plans. Consultation on drafts of the flood risk management plans have been ongoing since 22 December 2014. Website www.powodz.gov.pl is platform to inform stakeholders and the public. General aim of the public involvement in preparation the flood risk management plans are improvement decision-making and increase acceptance the plans.

Regionalny Zarząd Gospodarki Wodnej we Wrocławiu jest w trakcie realizacji procesu wdrażania udziału społeczeństwa w podejmowaniu decyzji - zgodnie z art. 14 Ramowej Dyrektywy Wodnej - na obszarze Regionu Wodnego Środkowej Odry. Początkowo prace koordynacyjne nad wdrażaniem prowadził Zespół ds. Udziału Społeczeństwa, powołany jeszcze przy Departamencie Zasobów Wodnych w Ministerstwie Środowiska. Obecnie działa on przy Departamencie Planowania i Zasobów Wodnych w Krajowym Zarządzie Gospodarki Wodnej. Zespół składa się z przedstawicieli poszczególnych RZGW prowadzących prace w obrębie swoich regionów wodnych.

The Regional Water Management Board in Wrocław is implementing the project of social participation in decision-making - in accordance to the article 14 of the Framework Water Directive - in the area of the Middle Odra Water Region. At the beginning, the implementation coordination works were being conducted by the Social Participation Team, established also at the Water Resources Department in the Ministry of Environment. At present, it acts as part of the Department of Water Planning and Resources, within the National Water Management Board. The team is composed of different RWMB representatives, conducting works in the area of their water regions.

Regionalny Zarząd Gospodarki Wodnej w Krakowie przystąpił do kolejnego etapu sporządzania planów gospodarowania wodami, jakim jest identyfikacja najistotniejszych problemów związanych z wodą i środowiskiem wodnym na swoim obszarze działania. Postanowił zaprosić do wspólnej identyfikacji tych problemów członków Rady Gospodarki Wodnej Regionu Wodnego Górnej Wisły oraz Stałej Komisji ds. Udziału Społeczeństwa. Ciała te skupiają łącznie 46 osób reprezentujących interesy zarówno władz lokalnych i regionalnych, jak i różnych środowisk zainteresowanych użytkowaniem wód na obszarze działania RZGW w Krakowie, łącznie z ekologicznymi organizacjami pozarządowymi. W trakcie spotkania w Dobczycach wypracowana została lista istotnych problemów gospodarki wodnej uszeregowanych według ważności występowania w poszczególnych regionach wodnych.

The Regional Water Management Board in Krakow started a subsequent stage of preparing water management plans, i.e. identification of the most eminent problems related to the water and to the water environment in the area of its activity. It decided to invite for common identification members of the Upper Vistula Water Region Water Management Board and of the Permanent Committee for Social Participation. Those authorities consist of jointly 46 people representing the interests of local authorities and of different environments interested in using waters on the territory of the Regional Water Management Board's in Krakow activity, including ecological non-governmental organisations. During the meeting in Dobczyce a list of important problems of water management was prepared, following the order of importance of occurrence in different water regions.

The Regional Water Management Boards, the institutions responsible for water management, began developing the river basin management plans, which realization is to ensure achieving the good water status by the year 2015 according the Water Framework Directive. The Water Law predicts three steps of public consultation during the process of the RBMP developing. In order to test new activities and procedures on a smaller scale and in the dates earlier then the WFD obliged to, the Upper Vistula pilot basin was selected that includes the Vistula river from its sources to Raba estuary. At the beginning of the year 2006, the test of public consultation performed on the pilot area was finished. This article presents the results of performed consultation.
