Wpływ zmian ustrojowych w Polsce na funkcjonowanie nadzoru budowlanego

Utworzony w 1928 roku nadzór budowlany, którego zadaniem było czuwanie nad bezpieczeństwem i porządkiem publicznym w procesie budowlanym, ulegał istotnym zmianom zarówno w zakresie struktury organizacyjnej, jak i w zakresie katalogu powierzonych do realizowanych zadań. Na kształt obecnie funkcjonującego nadzoru budowlanego decydujący wpływ miały przede wszystkim przekształcenia ustrojowe, jakie zaszły w Polsce w 1989 r., a które doprowadziły do odbudowy samorządu terytorialnego. Wdrożenie reformy ustrojowej państwa, w tym wprowadzenie trójstopniowego podziału administracyjnego kraju, skutkowało dokonaniem podziału administracji państwowej działającej w dziedzinie budownictwa na dwa odrębne piony: organy administracji architektoniczno-budowlanej oraz organy nadzoru budowlanego. Podział ten, pomimo pojawiającej się krytyki odnośnie skuteczności działania tych organów, nadal obowiązuje.

The construction supervision, established in 1928, whose task was to ensure security and public order in the construction process, underwent significant changes both in terms of the organizational structure and the catalog of entrusted to fulfill tasks. However, the shape of the currently functioning construction supervision was primarily influenced by the political transformations that took place in Poland in 1989 and which led to the reconstruction of the local government. The implementation of the state system reform, including the introduction of a three-level administrative division of the country, resulted in the division of the state administration operating in the field of construction into two separate divisions: architectural and construction administration bodies and construction supervision bodies. This division, despite the emerging criticism regarding the effectiveness of these bodies, still applies.

This article focuses on individual effects of the transformation from communist to capitalist structures in the system of occupational health and safety (OHS). Despite basic similarities among the communist nations the systems of OHS differed immensely. The political changes during transformation additionally contributed to varying opportunities for the development of OHS systems. Changes affecting the living and working conditions are significant and are demonstrated by the development of new work structures and work biographies. This is reflected in changed attitudes to demands and contents of work. No differences, however, were found between the employed and unemployed when asked about these issues. Conclusions for OHS in postcommunist states are drawn.

W publikacji autor przedstawił pozycje sił zbrojnych w systemie politycznym demokratycznego państwa i społeczeństwa obywatelskiego. Demokratyczna kontrola nad wojskiem oznacza podporządkowanie armii demokratycznie wybranym władzom politycznym w trosce o bezpieczeństwo państwa i społeczeństwa. Proces wprowadzania cywilnej kontroli nad siłami zbrojnymi w Polsce realizowany był etapami i nie został jeszcze zakończony - pomimo członkostwa w NATO.

The paper presents the position of military forces in political system of democratic state and citizenship society. A democratic control over the army means that the army is ruled by democratically elected political authorities which take care for the state and the security of society. The civil control process over the military foces has been realized on the stages and has not been finished yet - in spite of NATO membership.
