In each business, certain confidentiality provisions are concluded. In the oil and gas business, information is a matter of importance. Therefore, it is routine in the petroleum industry to sign confidentiality clauses or confidentiality agreements. Also in many cases, the confidential information needs to be disclosed to certain third parties, either for completing the project or due to regulations. Hence, apparently, there would be a conflict between the confidentiality obligations and such disclosures to third parties. In this study, we analyse the risks and effects of the authorised disclosure of confidential information to third parties. The research hypothesis is that in the mentioned relations there is not enough coherence and accordance that can completely manage the safety of disclosed information. The main source of our research is Lex Petrolea (legal and contractual norms accepted internationally by governments and companies that are active in the petroleum industry).

W referacie omówiono zagadnienia związane z udziałem niezależnych jednostek oceniających zgodność w systemie zapewnienia bezpieczeństwa maszyn, ze szczególnym uwzględnieniem zharmonizowanego systemu europejskiego. Scharakteryzowano pojęcie strony trzeciej i wymagania, jakie powinny spełniać jednostki działające jako strony trzecie. Szczegółowo opisano rodzaje stron trzecich występujące w dyrektywach Unii Europejskiej, dotyczących maszyn. Przytoczono zasady notyfikacji i wymagania dotyczące jednostek notyfikowanych oraz ogólne procedury oceny zgodności, występujące w dyrektywach nowego podejścia. Wymieniono zadania jednostek notyfikowanych w zakresie dyrektyw: maszynowej, dźwigowej i niskonapięciowej. Zadania te zilustrowano blokowymi schematami postępowania przy ocenie zgodności. Scharakteryzowano pojecie nadzoru rynku i europejskie zasady jego prowadzenia. Podano informację o systemie nadzoru rynku (kontroli wyrobów wprowadzonych do obrotu) obowiązującym w Polsce. Opisano źródła prawne wymagań dotyczących inspekcji eksploatacyjnych oraz wymieniono przykładowe jednostki realizujące te zadania. Omówiono zalety i znaczenie certyfikacji dobrowolnej. Podano informacje o działalności Urzędu Dozoru Technicznego jako strony trzeciej.

In the paper are discussed several issues concerning the participation of independent conformity assessment bodies in a machinery safety assurance system. In particular, the harmonized European system is considered. The concept of a third party and the requirements to be fulfilled by bodies acting as third parties are characterized. The kinds of third parties which may take part in conformity assessment according to EU directives concerning machinery are described in details. The general rules of notification and conformity assessment procedures applied to New Approach directives are also quoted. Specified are the tasks of notified bodies in the fields of machinery, lifts and law voltage directives. These tasks have been illustrated by block diagrams showing the mains steps in conformity assessment. The concept of the market surveillance and the European principles of carrying it out are characterized as well as the system of market surveillance (inspection of products placed on the market) in force in Poland. Described are also the legal sources for the requirements concerning in-service inspection and certain examples of the bodies which carry out such duties. Advantages and significance of voluntary certification are discussed. Information on the activities of Office of Technical Inspection activities as a third party is given.
