Technologia BIM coraz częściej wykorzystywana jest w polskim budownictwie, również przez zamawiających publicznych. Celem artykułu jest analiza wybranych polskich postępowań przetargowych, w których zamawiający w przedmiocie zamówienia wskazał obowiązek wykorzystania technologii BIM. Analizie ilościowej i jakościowej podano 25 wymagań technologii BIM stawianych wykonawcom w wybranych 15 polskich postępowaniach przetargowych.

BIM technology is increasingly being used in the Polish construction industry, also by public procurers. The purpose of this article is to analyse selected Polish tender proceedings in which the contracting authority has indicated in the subject of the contract the obligation to use BIM technology. A quantitative and qualitative analysis was made of 25 BIM technology requirements for contractors in selected 15 Polish tendering procedures.

W Polsce w ostatnich latach znacznie wzrosła dynamika podejmowanych i planowanych inwestycji związanych z realizacją podziemnych sieci sanitarnych. Wiele z tych inwestycji jest realizowana z pomocą dofinansowania z UE. Warto zadbać, aby środki te były zużywane możliwie najefektywniej. Jednym z ważnych etapów osiągnięcia tego celu jest właściwe przygotowanie tych inwestycji. Istotnym elementem jest zatem szczegółowa analiza dokumentów kontraktowych oraz zmian, jakie zachodzą w kontekście nowelizacji podstawowych aktów prawnych, jak np. nowelizacja ustawy Prawo budowlane i Rozporządzenie Ministra Rozwoju w sprawie szczegółowego zakresu i formy projektu budowlanego. W artykule zaprezentowano analizę zagrożeń, jakie mogą wystąpić w trakcie planowania oraz realizacji przedsięwzięć budowlanych, pozyskiwanych w ramach zamówień publicznych.

In Poland, the dynamics of undertaken and planned investments related to the implementation of underground sewer lines has significantly increased in recent years. Many of these investments are implemented with the help of EU funding. It is worth ensuring that these resources are used as efficiently as possible. One of the important steps in achieving this goal is the proper preparation of these investments. An important element is therefore a detailed analysis of contract documents and changes that occur in the context of the amendment of basic legal acts, such as the amendment to the Construction Law Act and the Regulation of the Minister of Development on the detailed scope and form of the construction project. The article presents an analysis of threats that may occur during the planning and implementation of public contracts projects.

The occurrence of errors in public works tender documentation is an undesirable phenomenon which is unfortunately often encountered in construction practice. Errors may have various causes and also have varying levels of negative effects on the successful implementation of the investment project. Taking this fact into consideration, this paper aims to identify and assess errors in terms of the requirements laid down by the applicable legislation in the Czech Republic, especially the Public Procurement Act and the associated implementing decree. A total of 126 public tenders were analysed in detail from this perspective. The results show that the occurrence of particular errors is relatively high, especially with regard to the specification of the bill of quantities and the requirement to include references to openly accessible price systems. Furthermore, errors relating to the specification of the quantity of works, units of measurement and descriptions of cost items were identified as having the largest impact on a project. Findings presented in this paper aim to highlight common errors in public tender documents and raise awareness of the need to improve their quality to ensure legislative compliance.

Zamawiający publiczny chcąc zrealizować inwestycję budowlaną jest zobowiązany właściwie przygotować i przeprowadzić procedurę wyboru wykonawcy. W artykule przeanalizowano łącznie 94 postępowania dotyczące robót budowlanych, przeprowadzonych przez Urząd Miasta Krakowa oraz Urząd Miasta Szczecina w latach 2010, 2011. Uwagę skupiono na pytaniach zadawanych przez wykonawców w analizowanych procedurach. Wyniki badań wskazują, że najwięcej problemów przysparza wykonawcom przekazywana przez zamawiających dokumentacja projektowa. Dużo pytań dotyczyło także wymagań co do materiałów budowlanych. Braki i nieścisłości w dokumentacji powodują często konieczność wprowadzania zmian i uzupełnień przez zamawiających. Za pozytywny można uznać fakt, że w żadnym z analizowanych przypadków nie wystąpiła konieczność przedłużenia terminu składania ofert.

In order to perform a building project a public awarding entity is required to prepare properly and execute the procedure for selecting the contractor. In the article the authors examine the case for a total of ninety-four public works contracts conducted by the City of Krakow and the City of Szczecin in the years 2010–2011. Attention was focused on the questions asked by the contractors in the analysed public procurements. The results of the research show that most problems the contractors have are design documentation prepared by public entities. Numerous questions were about the requirements for building materials. Incomplete tender documentation and inconsistencies in the documentation often result in the need to make changes and additions by the authorities. It can be regarded as a positive fact that in none of the analysed cases it was necessary to extend the deadline for submission of tenders.
