W niniejszym artykule podjęto próbę udzielenia odpowiedzi na trzy pytania: a) czy i w jakim zakresie projekty branżowe i ekspertyzy techniczne mogą być objęte ochroną prawa autorskiego; b) kto może być uznany za ich twórcę; c) jakie są najważniejsze - zdaniem autorki - praktyczne implikacje takiego stanu z punktu widzenia właścicieli firm projektowych i inżynierskich oraz osób w nich zatrudnionych.

This article attempts to answer three questions: a) whether and to what extent industry projects and technical expertise may be protected by copyright; b) who can be considered their creator; c) what are the most important - according to the author - practical implications of such a state from the point of view of the owners of design and engineering companies and people employed in them.

Celem artykułu jest omówienie zrozumiałym dla nieprawników językiem typowych klauzul umownych dotyczących przekazywania i wykonywania praw autorskich, które pojawiają się w podpisywanych przez inżynierów umowach podwykonawczych (zleceniach) na projekty branżowe i ekspertyzy techniczne. W artykule pokazano też, jakie mogą być skutki sytuacji, gdy inżynier pracuje na rzecz architekta bez spisanej umowy albo gdy, pomimo podpisania stosownej umowy, niezasadnie wstrzymano mu płatność należnego wynagrodzenia.

The purpose of the article is to discuss the language understood by lawyers in typical contractual clauses regarding the transfer and exercise of copyrights, which appear in subcontractor contracts (order jobs) signed by engineers for industry projects and technical expertise. The article also shows the effects of a situation when an engineer works for an architect without a written contract or when, despite signing the relevant contract, they were unjustifiably suspended from payment of due remuneration.

The study is a result of research conducted in the environments of engineering and technical employees in industrial enterprises. The authors indicate the main dilemmas of modern entrepreneurship and innovation and present a development methodology based on a parallel increase in the adaptability of cultural and technological innovation. The authors have exposed a language and tool gap in the context of electronic communication and information processing technology, in particular, the effects of application of integrated computer systems CAD/CAM/CAE with a three-dimensional and animated option of electronic documents PDF and DOC.
