Autorzy omawiają zagadnienie możliwości uwolnienia się przewoźnika od odpowiedzialności za szkody spowodowane wadą lub awarią środka transportowego. Analiza przepisów międzynarodowych i krajowych prowadzi do wniosku, że stan pojazdu, jako samoistna przyczyna szkody, objęty jest zakresem odpowiedzialności przewoźnika we wszystkich analizowanych aktach prawnych. Przewoźnik nie może powoływać się na niego, nawet jeśli został spowodowany przez osobę trzecią, niebiorącą udziału w wykonywaniu zobowiązania. Wyjątek zawiera konwencja CMR, która może być interpretowana w taki sposób, że przewoźnik może uwolnić się od odpowiedzialności za wady lub awarie urządzeń chłodniczych zainstalowanych na pojeździe, jeśli udowodni, że przedsięwziął wszelkie obowiązujące go w danych okolicznościach środki związane z wyborem, utrzymaniem i użyciem tych urządzeń oraz że zastosował się do specjalnych, udzielonych mu instrukcji. Przewoźnik każdej gałęzi transportu może się uwolnić od odpowiedzialności, jeśli wykaże, że wada lub awaria pojazdu spowodowane zostały z winy nadawcy.

The authors present the issue of the carrier’s possibility to release himself from the liability for the damage caused by the defect or failure of the means of transport. The analysis of the international and domestic provisions leads to a conclusion that the technical condition of the vehicle, as an independent cause of the damage, is covered by the carrier’s liability in all of the analysed legal acts. The carrier is not allowed to invoke this circumstance, even if it was caused by a third party who is not engaged in the execution of the contract. However, one exception may be found in CMR Convention, which may be interpreted in a way allowing the carrier to exonerate from the liability for defect or failure of the refrigeration equipment installed on the vehicle, if he proves that he took all necessary and applicable measures regarding the choice, maintenance or use of the equipment and that the followed all given instructions. The carrier of each transport sector may release himself from the liability if he proves that the defect or failure of the vehicle was caused by the default of the consignor.

Particular attention was paid to the technical condition of the vehicle which is often the cause of many road accidents and collisions. In addition, it was estimated the cost of road accidents in order to draw attention to the importance of the discussed issues.

Artykuł opisuje stan systemu okresowych badań technicznych. Ponadto wskazano podstawowe przyczyny zewnętrzne i wewnętrzne mające istotny wpływ na jakość badań technicznych pojazdów. Przedstawiono również przepisy Komisji Europejskiej w zakresie okresowych badań technicznych mających na celu ujednolicenie zasad badań pojazdów, procedur oceny układu i zespołów pojazdów w całej Europie, a w konsekwencji poprawę stanu technicznego pojazdów. W artykule skupiono się również na omówieniu koncepcji systemu wspomagania decyzji w obszarze utrzymania środków transportowych. Zdefiniowano podstawowe decyzje jakie są podejmowane w procesie funkcjonowania systemów transportowych.

The article presents state of the periodic technical tests system. The internal and external root causes having a significant impact on the quality of the technical inspections of vehicles have been identified. The newly proposed provisions of the European Commission on the periodic roadworthiness tests are intended to standardize the principles of testing of vehicles , procedures for assessment of vehicles system and components throughout Europe, and consequently, improve the condition of the vehicles. More over the article is focused on the investigation of conception of desicion support systems for means of transport maintenance processes performance. Thus, the main decisions being taken in the area of transportation systems performance are defined.

Wszystkie środki transportu wykorzystywane przez przewoźników do realizacji zadania transportowego w regularnym przewozie osób muszą spełniać szereg warunków technicznych, co stanowi zakres tematyczny niniejszej publikacji. Opisano w niej również przykład spełnienia wszystkich wymagań przez jednego ze śląskich przewoźników – Tyskie Linie Trolejbusowe. Jest to jeden z trzech przewoźników komunikacji trolejbusowej w Polsce. Obsługuje taborem trolejbusowym pięć linii na zlecenie Miejskiego Zarządu Komunikacji w Tychach. „Ekologicznie do celu” – takim hasłem promowana jest komunikacja trolejbusowa w Tychach, jako bezemisyjna i całkowicie przyjazna dla środowiska. Przedsiębiorstwo realizuje tzw. przewozy regularne, czyli publiczne przewozy osób pomiędzy przystankami, według rozkładu jazdy i cennika podanych do publicznej wiadomości. All means of transport used by carriers to carry out transport task in regular passenger transport must meet a number of technical conditions, which is the thematic scope of this publication. It describes the example of all the requirements for one of the Silesian carriers - Trolley lines of Tychy. This is one of the three trolleybus communication carriers in Poland. Trolleybus fleet supports five lines on the order of the Municipal Board of Communications in Tychy. "Ecologically to the destination" - by this slogan is promoted communication trolleybus in Tychy, as emission-free and completely environmentally friendly. The company implements the so-called regular service, so public transport of passengers between stops, according to the timetable and the price list given to the public. The core of the fleet is the modern vehicles Solaris Trollino 12MB purchased thanks to European funds.

The impact of the economic crisis, i.e. the decrease in purchasing power in the Republic of Croatia, has been reflected negatively on the sales of new road vehicles and the maintenance plan of used road vehicles. A comparison of the results of technical inspections on vehicle roadworthiness has indicated a slight increase in unroadworthy vehicles, with a tendency for this to increase. Unroadworthiness and the average age of vehicles amounting to 12.18 years prompt for thinking about road safety in the Republic of Croatia. This paper aims to establish the extent of the increase in vehicle unroadworthiness and the importance of its reduction in order to increase road safety. The Republic of Croatia has adopted the National Road Safety Program for 2011-2020, accepting thereby a task that will be difficult to accomplish without organising training on the importance of vehicle roadworthiness.

Die Folgen der Wirtschaftskrise bzw. die verminderte Kaufkraft in der Republik Kroatien haben den Verkauf von neuen und den Instandhaltungsplan von gebrauchten Straßenfahrzeugen negativ beeinflusst. Durch den Vergleich der mit der Verkehrstauglichkeit von Straßenfahrzeugen verbundenen Ergebnisse technischer Kontrollen ließ sich ein leichter Anstieg von verkehrsuntauglichen Fahrzeugen, mit einer Tendenz zur Erhöhung, feststellen. Die technische Untauglichkeit sowie das Durchschnittsalter von Straßenkraftfahrzeugen von 12,18 Jahren lassen Bedenken über die Sicherheit des Straßenverkehrs in der Republik Kroatien aufkommen. Das Ziel dieser Untersuchung war es festzustellen, wie stark die Verkehrsuntauglichkeit von Straßenfahrzeugen angestiegen ist sowie auf die Wichtigkeit ihrer Minderung hinzuweisen, mit dem Zweck, die Sicherheit des Straßenverkehrs zu erhöhen. Die Republik Kroatien hat das Nationalprogramm der Sicherheit im Straßenverkehr 2011-2020 verabschiedet und sich dadurch vor eine schwierige Aufgabe gestellt, die sie ohne Schulungsveranstaltungen, welche die Wichtigkeit der Verkehrstauglichkeit von Fahrzeugen zum Thema haben, wohl kaum erfüllen kann.

Wypadki drogowe, których przyczyną był stan techniczny pojazdów są przedmiotem dyskusji i polemik często opartych na domniemaniach i przesądach. Celem pracy jest analiza światowych i krajowych badań w tym zakresie oraz analiza prac własnych Instytutu Transportu Samochodowego. Przedstawiono wyniki różnych badań prowadzonych przez międzynarodowe instytucje oraz Instytut Transportu Samochodowego. Opisano szczegółowo statystyki wypadków drogowych na podstawie wiarygodnych danych z Niemiec i Polski. Szczegółowe wyniki analiz statystycznych wskazują na mały wpływ stanu technicznego pojazdu na wypadki drogowe. Wypadek drogowy jest wynikiem głównie błędów kierującego pojazdem.

Road accidents caused by the technical condition of the vehicles are a subject of discussions and polemics often based on assumptions and prejudices. The aim of this study is to analyze the global and national researches in this field and the analysis of the Motor Transport Institute’s own work. There are results presented of various studies carried out by international institutions and Motor Transport Institute. The statistics of road accidents have been described in detail based on reliable data from Germany and Polish. Detailed results of the statistical analysis indicate a small effect of the vehicle’s condition on the road accidents. Road accident is due mainly to the vehicle operator’s errors.

Pojazdy sanitarne uprzywilejowane podczas prowadzenia akcji ratunkowych poruszają się w ruchu drogowym z dużymi prędkościami i często w sposób niekonwencjonalny. Celem ograniczenia liczby możliwych w takich przypadkach niebezpiecznych incydentów w ruchu drogowym, muszą wyróżniać się spośród innych pojazdów. Aby pojazd sanitarny uprzywilejowany był widoczny i zauważalny z dużych odległości w szczególności w porze nocnej, musi być odpowiednio oznakowany za pomocą barwnych znaków o właściwościach odblaskowych. Niemniej istotną rolę spełniają sygnały dźwiękowe. Na tle obowiązującego w Polsce prawa, w tym międzynarodowego, opisano istniejące niespójności przepisów w zakresie oznakowania, wymagań technicznych dla folii odblaskowych oraz uprzywilejowanych sygnałów ostrzegawczych. Wskazano konieczne kierunki zmian w przepisach celem poprawy bezpieczeństwa w ruchu drogowym w obszarze dotyczącym ruchu drogowego pojazdów sanitarnych – uprzywilejowanych.

Ambulances being privileged vehicles while attending to the emergency are moving in the road traffic at high speeds and often in an unconventional manner. In order to limit the number of possible of dangerous incidents on the road, in such cases, they must stand out among other vehicles. The privileged ambulance, in order to be visible and noticeable from long distances especially at night, must be labelled with the colourful markings of reflective characteristics. However, an important role is played by audible signals. The existing inconsistencies concerning labelling regulations, the technical requirements for reflective foils and the priority warning signals are described against the background of the law in Poland, and international one. The necessary directions of changes have been indicated in respect to the regulations to improve safety in road traffic concerning the movement of privileged ambulances.

Artykuł jest próbą znalezienia relacji pomiędzy wdrożonym systemem okresowych badań technicznych pojazdów, a liczbą zdarzeń drogowych i szerzej niezawodnością pojazdów i bezpieczeństwem ruchu drogowego. W pracy między innymi wykorzystano wyniki badań porównawczych, dla których można było wprost obserwować zależność i parametry dla przypadków z wdrożonym systemem okresowych badań technicznych i bez niego (na przykładzie Stanów Zjednoczonych, Australii i Norwegii). Analiza wyników prowadzi do zaskakującego wniosku, że wyżej wymieniony system nie ma statystycznie istotnego wpływu na liczbę wypadków, w tym liczbę zdarzeń drogowych z udziałem ofiar śmiertelnych.

The article is an attempt to find relationship between the implemented system of periodic technical inspections of vehicles and the number of road accidents, reliability of vehicles and road safety. The study utilises results of comparative tests, where the relationships and parameters could be directly observed for the cases with the system implemented and some without periodic technical inspections at all (for example: between the states of the USA, Australia and the research work conducted in Norway in the 90’s). The analysis of results leads to unexpected conclusion that system of periodic technical inspections of vehicles does not have statistically significant effect on the number of accidents, including the number of road accidents involving fatalities.

The influence of technical conditions and the age structure of vehicles on traffic emission

The article presents the results of the simulation of the traffic emission from vehicles for different type of roads. The calculations of emission have been made by using the methodology which is used in Europe. To register the number and the type of vehicles for each road a digital camera was used. The traffic stream has been recorded in the same length of time. The investigations have been made for different classes of roads with different types of vehicles. There was estimated number of the vehicles per vehicle category and the agę structure of the vehicles for each type of road. The vehicles have been divided into different exhaust emission legislation classes. Additionally, measurements of the group of 300 different vehicie have been made. Those measurements provided information about the level of emission from each vehicle. The total vehicle emission was calculated depending on the type of road, the number of vehicles, the number of vehicles per vehicle category, the age structures, the average speed per vehicle type etc. At first, the simulation of the traffic emission from vehicles was made, taking into consideration the fact, that the vehicles are in good technical conditions. Next, the calculation was made for real technical conditions of vehicles. This investigation has shown that the technical conditions of the vehicles have an important influence on the estimated emission level.
