W artykule wykazano, jak została naruszona zasada kwalifikowalności wydatków projektu, wynikająca z błędnego działania Instytucji Pośredniczącej pierwszego konkursu, ogłoszonego w ramach Działania 1.1 Programu Operacyjnego Polska Cyfrowa. Wskazano konsekwencje podpisanych przez IP umów o dofinansowanie z naruszeniem zasad, które zostały ustalone przez IP. Dostrzeżono trzy typy naruszenia zasady kwalifikowalności, mające szczególnie istotny wpływ na rozwój inwestowania w infrastrukturę światłowodową operatorów telekomunikacyjnych w Polsce.

This article proves how the principle of eligibility of project expenses resulting from the incorrect operation of the Intermediate Body of the first competition announced under Measure 1.1 of the Operational Program Digital Poland was violated. The consequences of grant agreements signed by IB were indicated in violation of the principles, that were set by the IB. Three types of violation of the eligibility rules have been identified that have a particularly significant impact on the development of investment activities in the fiber optic infrastructure of telecommunications operators in Poland.

Od 2010 roku w Polsce są prowadzone działania, mające na celu wsparcie, rekomendowanie i usystematyzowanie rozwoju usług szerokopasmowych. Czynnikiem inicjującym rekomendacje i zmiany ustawodawcze stała się Europejska Agenda Cyfrowa, w której dostrzeżono znaczenie postępu technologicznego i dążenie społeczeństwa do innowacyjnych technologii. W ślad za opinią środowiska ekspertów wprowadzone zostały regulacje prawne wspierające proces inwestycyjny realizowany przez przedsiębiorców telekomunikacyjnych. W artykule przedstawiono główne ustawowe przywileje przedsiębiorców telekomunikacyjnych w procesie inwestycyjnym, normujące przebieg uzyskiwania pozwoleń i uzgodnień związanych z ulokowaniem infrastruktury telekomunikacyjnej w pasie drogowym.

Since 2010 activitiesin Poland are prosecuted with the target to support, recommend and systematise the development of broadband services. The factor initiating recommendation and legislative changesbecame the Digital Agenda for Europe, who saw the importance of technological advance and the public aim for technological innovations. Following the opinion-forming expert community, legislative regulations were introduced supporting the investment process, by communications service providers. The article presents the main legal privileges of communications service providers in the investment process standarising the course of obtaining permission and agreements attached to locate the telecommunication infrastructure in the vehicular zone.

Uwarunkowania prawne określają następstwo zdarzeń w procesie budowy światłowodów, precyzując, jakie kroki zobowiązany jest przeprowadzić inwestor, by zrealizować zamierzoną inwestycję. Powinno to oznaczać, że – dokonując implementacji procesu – inwestor powinien mieć zagwarantowany rezultat przy spełnianiu nakładanych na niego wymogów. Jednak czy tak jest? Artykuł prezentuje algorytm, odzwierciedlający realizację procesu uzgodnień i uzyskiwania decyzji wymaganych dla FTTH doziemnego wraz z weryfikacją zaproponowanego algorytmu na podstawie studium przypadku prezentującego wykonalność inwestycji na drogach gminnych. Wsparcie komputerowe optymalizacji procesu inwestycyjnego w obszarze sieci światłowodowych zapewnia analizę kosztów poszczególnych elementów sieci, trasowania i projektowania. Jednak oprogramowanie to nie uwzględnia przebiegu procesu uzgodnień projektów, co w rzeczywistości decyduje, czy dana inwestycja jest wykonalna.

The legal condition ings determine the succession of events in the process of optical fiber construction, specifying what steps an investoris required to carry out to accomplish the intended investment. This should mean, that when meeting the requirement simposed on him and implementing the process, the investor should have a guaranteed result. However, is it like that? The article presents an algorithm reflecting the execution of the arrangement process and obtaining the decisions required for FTTH ground-based together with the verification of the proposed algorithm based on a case study demonstrating the feasibility of investments on municipalroads. The issue of optimizing the investment process in the field of fiber-optic networks is considered in detail, having regard to costs of individual elements of the network, to routing and planning. This software however does not take the course of the arrangement process in to account, which in fact decides whether a given investment is manageable.

W Polsce dostęp do szerokopasmowego Internetu z roku na rok jest coraz lepszy. Dla dalszego rozwoju istotne powinno być wejście w życie ustawy o wspieraniu rozwoju usług i sieci telekomunikacyjnych. W ciągu najbliższych pięciu lat ma ono umożliwić powszechny dostęp do szerokopasmowego Internetu.

The development of broadband in Poland from year to year is becoming easier and more affordable. For the further development of broadband in Poland should be a significant entry into force of the Act to promote the development of telecommunications networks and services (May 7, 2010). Generally, over the next five years, the law is intended to allow Poles the universal broadband.
