Celem badań zaprezentowanych w artykule jest wskazanie wpływu podwykonawstwa zadań w zakresie odroczonej produkcji na zakłócenia w przepływach materiałowych. Rozważano czy wzrost relacji sieciowych jest czynnikiem wspomagającym budowanie odporności łańcucha dostaw czy zwiększa wrażliwość łańcucha dostaw na zakłócenia. Badania zrealizowano w łańcuchu dostaw wyrobów hutniczych.

Indicating the influence of the subcontracting of tasks in the postponed production for disruptions in material flows is a purpose of the article. They were considering whether the height of network relations was a factor assisting building the resilience of the supply chain whether is increasing the sensitivity of the supply chain on disruptions. Examinations were carried out in the supply chain of smelting products.

W artykule podjęto próbę analizy rentowności zastosowania outsourcingu w operacyjnym zarządzaniu produkcją budowlaną. Wskazano na zadania outsourcingu w systemie podwykonawczym, który jest coraz częściej spotykanym narzędziem sterowania produkcją i usługami, w tym również kontraktami budowlanymi. Na wybranych przykładach przedstawiono główne przesłanki przemawiające za wyborem tej strategii zarządzania w procesie tworzenia produktu. Ustalono, że zastosowanie outsourcingu pozwala na wykorzystanie potencjału kontrahentów, zdywersyfikowanie wyspecjalizowanych usług, poparte wyższą jakością i wydajnością, a także niższe koszty wewnętrzne, w porównaniu z dużymi podmiotami/korporacjami, realizującymi projekty w systemie generalnego wykonawstwa.

Throughout the article, the author makes an attempt to analyze the profitability of using the outsourcing process, in the operational management of building works. The article indicates the outsourcing tasks in the subcontracting system, which is more and more often being used as a tool for controlling the executed works, including the contracts concluded in the construction and building industry areas. The selected examples present the main premises that support this management strategy throughout the process of creating the product. The findings allow us to establish that application of outsourcing makes it possible to use the potential of the customers, diversify the specialized services, as higher effectiveness and quality may be achieved. Finally, the internal costs are limited, especially in comparison with large businesses/corporations, realizing the projects with the use of the general contractor system.

Podstawowym aktem prawnym, regulującym kwestię udzielania zamówień publicznych, jest ustawa z dnia 29 stycznia 2004 r. Prawo zamówień publicznych. W 2013 r. wprowadzono do niej zmiany w zakresie praw i obowiązków zamawiającego roboty budowlane, które mają zastosowanie w postępowaniach po wejściu w życie w tym roku ustawy nowelizującej.

W dniu 11 marca 2013 r. projekt ustawy o zmianie ustawy Prawo zamówień publicznych, przyjęty na posiedzeniu Rady Ministrów w dniu 12 lutego 2013 r., został skierowany do Sejmu. Dotyczy on uregulowania kwestii podwykonawstwa i podwykonawców w zamówieniach publicznych – przewiduje w tym zakresie zmiany o zasadniczym, a momentami wręcz rewolucyjnym charakterze. Przykładowo zamawiającym dano szerokie możliwości wyłączenia swojej odpowiedzialności. Artykuł szeroko omawia projektowane przepisy.

On 11th March 2013 the draft amendments to the Public Procurement Act adopted during the session of the Cabinet on 12th February 2013, was submitted to the parliament. Its purpose is to settle the matter subcontracting and subcontractors within public procurement, while the proposed changes are of a fundamental, if not of a revolutionary character. As an example, the clients have received vast disclaimer options. According to the justification to the draft text, the new provisions are supposed to regulate subcontracting in public procurement in a comprehensive manner, so that the provisions of the Civil Code, particularly article 6471, applied as a result of reference included in article 139 of the Public Procurement Act, would virtually become void in terms of public procurement. The drafted provisions can be roughly split into two groups, first concerning subcontracting as a whole, and the second dealing with the procurement of construction works.

W artykule rozważono podwykonawstwo operacji produkcyjnych w systemie dystrybucji z odroczoną produkcją. Współpraca nawiązywana z podwykonawcą dotyczy motywu realizacji wybranych operacji produkcyjnych u kooperanta dla potrzeb terminowej i kompletnej realizacji zamówień. Wskazano, że typ relacji istotnie wpływa na dostępność zasobu partnera. Typy relacji międzyorganizacyjnych pomiędzy partnerami w sieci oceniono z perspektywy ilości zamówień utraconych. Sieci dystrybucji scharakteryzowano uwzględniając istotę podwykonawstwa zadań związanych z odroczoną produkcją.

In the article they considered shaping network relations for the motive for acquiring resources of partners for the purposes of the timely and complete order processing. They showed that the type of the relation indeed influenced the availability of the store of the partner. Types of the relation between partners online were assessed from a perspective of the number of lost orders. Distribution networks were characterized including the postponed production. Simulation modeling was conducted based on the model of dynamics of systems.

Most companies use the services of subcontractors, either in their core business, or to support the work – e.g. maintenance. This poses the need for effective and systematic monitoring of the work of subcontractors, especially if they perform it on the premises of an enterprise. In some industries such as construction, energy, petrochemicals, metallurgy and foundry additional system requirements appear, particularly with regard to safety and the environment, a compliance with which is necessary to obtain an order. Often, conformity with these requirements must be confirmed with a certificate. The article presents examples of standardised special requirements, such as SCC / VCA, SCT / VCU, SQAS used for sub-contractors of construction work, maintenance, scaffolding etc. in the European Union member states.
