Przedmiotem artykułu są zmiany wprowadzone do ustawy – Prawo o ruchu drogowym ustawą z dnia 23 marca 2017 r. o zmianie ustawy – Kodeks karny oraz niektórych innych ustaw. Szczególną uwagę autor poświęca zmianom w zakresie kontroli trzeźwości kierującego pojazdem przez uprawnione do tego organy w trakcie kontroli drogowej. Przedstawia poszczególne zmiany wprowadzone ustawą nowelizującą, omawia je oraz stara się przedstawić własne stanowisko w zakresie wprowadzonych zmian.

The subject of this article is the discussion of the changes introduced to the Act on the Road Traffic by the Act of 23 March 2017, “Amendment of the Penal Code and some other laws”. Special attention is devoted to changes in the driver's sobriety control by authorised bodies during roadside inspections. The author presents changes introduced by the amendment, discusses them and tries to present his own position on the changes.

Artykuł porusza istotne zagadnienia związane ze spowodowaniem niebezpieczeństwa w ruchu drogowym. Zagadnienie to do tej pory umykało uwadze badaczy, a jest istotne, dotyczy bowiem zagadnień występujących na przedpolu przestępstwa drogowego bądź po jego zaistnieniu. Autor omawia problematykę wywołania niebezpieczeństwa na trzech płaszczyznach: postępowania człowieka, czynnika technicznego oraz drogi i organizacji ruchu. Analizuje zagadnienie od strony prawnej i kryminologicznej. Wskazuje, że po stronie człowieka istnieje wiele elementów tworzących niebezpieczeństwo, wielokrotnie od niego zależnych, ale też nierzadko pozostających poza jego wpływem. Wskazuje na kwestie związane z osłabieniem reakcji psychomotorycznej, z użyciem alkoholu i środków psychoaktywnych, stanem zdrowia, zmęczeniem i kwestiami związanymi z kwalifikacjami kierującego, jego doświadczeniem, a także czynnikami wpływającymi na czas reakcji. Omawia zagadnienia związane z wpływem na wypadkowość niesprawności pojazdów, stanem i wyposażeniem drogi, jak też organizacją ruchu. Stara się wykazać, że oceny związane z przyczynami wywołanego niebezpieczeństwa w ruchu drogowym nie leżą wyłącznie po stronie jego uczestników.

The article raises a number of significant issues related to causing threat in road traffic. This is a subject that has so far largely escaped the attention of researchers, but it is important, especially as it concerns issues that can be thought of as being in the foreground of traffic offences or after they have occurred. The author discusses the issue of causing threat on three levels: human behaviour; technical factors; and roads and the organisation of traffic. He analyses the issue not only from a legal point of view but also a criminological one. He indicates that, in terms of human behaviour, there are many elements causing threat, which are frequently dependent on the given person, but also sometimes beyond his/her control. The author points to issues linked with the weakening of psychomotor reactions, the use of alcohol and psychoactive substances, the driver’s state of health, fatigue, and other issues related to, e.g., the qualifications of the driver, his/her experience, as well as factors affecting reaction time. Furthermore, he discusses issues related to the effect of poor conditions of vehicles, the state of the road and road equipment (signage, barriers, lighting etc.), as well as traffic management, on accident rates. He tries to show that evaluations linked with the causes of the evoked threat in road traffic should not focus exclusively on participants in the accident.
