Limitations of the access to spatial data and services due to intelectual property rights. Polish perspective

The Inspire Directive introduces a conceptual framework related to spatial data infrastructure, unifying the issues related to the access to spatial data within the European Union. The Directive was implemented into Polish law in the Act of 4 March 2010 on spatial information infrastructure. Both the Directive and the Act provide for the possibility of introducing limitations to access to spatial data and services in connection if access would adversely affect, among others, intellectual property rights. The carried out study shows that most poviats subject to the study have not acquired the required scope of intellectual property which may potentially result in the access limitations.

W zakresie sporządzania miejscowego planu zagospodarowania przestrzennego (mpzp) jednym z tematów, który do tej pory nie doczekał się systemowych rozwiązań uregulowanych przepisami wykonawczymi jest cyfryzacja opracowania w powiązaniu ze standaryzacją i harmonizacją danych planistycznych na potrzeby infrastruktury informacji przestrzennej. Niniejsza publikacja stanowi głos w dyskusji dotyczącej potrzeby podjęcia działań zmierzających do pilnego wprowadzenia jednolitych w skali kraju założeń do realizacji i publikacji miejscowych planów zagospodarowania przestrzennego w postaci wektorowej. Celem głównym opracowania jest przedstawienie wybranych aspektów tworzenia numerycznych opracowań, które mogłyby być wstępem do wypracowania wytycznych dla wykonawców planów miejscowych. Celem szczegółowym jest analiza zmian w ustawie o planowaniu i zagospodarowaniu przestrzennym dotyczących zakresu i postaci danych przestrzennych planów miejscowych.

In the field of elaboration of a local plan, one of the topics that has not yet been solved by systemic solutions regulated by implementing rules is the digitization of the plan in conjunction with the standardization and harmonization of planning data for spatial data infrastructure. The paper is a voice in the discussion on the need to take action to urgently introduce assumptions for the implementation and publication of local spatial plans in a vector form. The main objective of the paper is to present the selected aspects of numerical spatial plans that could be a base for developing of guidelines for contractors for local plans. The detailed objective is the analysis is of the amendments to the act spatial planning concerning the scope and form of spatial data of local plans.

Dyrektywa INSPIRE (2007/2/WE) zobowiązuje Polskę, jako państwo członkowskie Wspólnoty Europejskiej, do utworzenia infrastruktury informacji przestrzennej (IIP), obejmującej m.in. zharmonizowane z przepisami implementacyjnymi INSPIRE zbiory danych przestrzennych dotyczące tematów wyszczególnionych w załącznikach I-III do tej dyrektywy. Od wejścia w życie dyrektywy INSPIRE minęły trzy lata. W okresie tym po stronie Komisji Europejskiej trwały intensywne prace nad przepisami wykonawczymi, zakończone opracowaniem projektu rozporządzenia w zakresie interoperacyjności zbiorów danych przestrzennych i usług (Draft Commission Regulation, 2009), natomiast w państwach członkowskich dokonano transpozycji dyrektywy i rozpoczęto budowę krajowych infrastruktur informacji przestrzennej. Kalendarz INSPIRE zakłada, że proces udostępniania zbiorów danych przestrzennych zgodnych z przepisami wykonawczymi rozpocznie się w czerwcu 2012 r. (nowe zbiory danych przestrzennych z załącznika I) i będzie trwał do końca maja 2019 r., kiedy to jest planowane udostepnienie nowych pozostałych zbiorów danych przestrzennych z załączników II i III. Wszystkie zbiory danych przestrzennych, zgodnie z przepisami wykonawczymi, muszą być opisane metadanymi i udostępnione z wykorzystaniem usług sieciowych. Opisane prace badawcze były wykonane w Instytucie Geodezji i Kartografii na zlecenie Głównego Geodety Kraju.

The INSPIRE Directive 2007/2/EC requires Poland, as a Member State, to establish the infrastructure for spatial information including, inter alia, harmonised spatial data sets and services for the themes listed in Annexes I to III to the Directive. Within this infrastructure, Member States are required to make available data sets related to one or several of the Annexes of the Directive 2007/2/EC and the corresponding spatial data services in conformity with the technical arrangements for the interoperability and, where practicable, harmonisation of spatial data sets and services. In order to achieve and ensure interoperability and harmonisation across spatial data themes, the Member States should meet requirements, listed in technical specification, for common data types, the identification of spatial objects, metadata, generic network model and other concepts and rules that apply to all spatial data themes. One of the first stages of Spatial Information Infrastructure implementation is establishing a list of the spatial data sets and spatial data services corresponding to the themes listed in Annexes I, II and III to the Directive 2007/2/EC, grouped by theme and Annex, and of the network services referred to in Article 11(1) of that Directive, grouped by service type. The spatial data sets and relevant spatial services, included in this list, maintained by public authorities, form the basic (primary) and complementary geoinformation resources for Polish Spatial Information Infrastructure. The paper presents, in a synthetic way, the results of work done in 2009 by the Institute of Geodesy and Cartography for the Head Office of Geodesy and Cartography. The objective of this research was the identification of data sets and services for themes included in Annex I of the INSPIRE Directive and testing their compliance with INSPIRE technical specification. The difficulty in preparing harmonised spatial data sets for themes listed in Annex I vary between themes. Harmonisation of each themes requires a different methodological approach and technological development based on the INSPIRE data specifications and existing data sets. For most Polish data sets corresponding to the themes listed in Annexes I harmonisation should precede integration of data held by different bodies of public administration.
