The article presents the administrative and legal regulations for the organization of public assemblies in relation to the state’s competence in the field of security logistics. The aim of the article is to indicate the legal possibilities of the state in the field of organizing public assemblies. The research problem was formulated in the form of a question: How do public authorities performing tasks in the field of state security logistics fulfill the constitutional norm granting a person the freedom of assembly. The research hypothesis that has been verified is: The public authority has a wide range of possibilities both in terms of organizing public assemblies and ensuring their safety. The period between its notification and its holding is not without significance for the security logistics of a public assembly. Considerations on the topic will be based on the available literature on the subject, normative acts, personal observations, as well as other sources of information illustrating the course and control of public assemblies. The assessment of local government authorities evaluating the registered manifestations, as well as their applications for permission to hold an assembly or its prohibition, will also be of key importance for the consideration of the subject. Conclusions from the conducted research were formulated in the last part of the article. The most important conclusions include that Public authorities have a wide range of competences both in terms of organization and the ability to ensure public security. In addition, the amended Act on Public Assemblies introduced in 2015 significantly contributed to increasing the powers of local governments.

W artykule przedstawiono administracyjno-prawne regulacje organizacji zgromadzeń publicznych w odniesieniu do kompetencji państwa w zakresie logistyki bezpieczeństwa. Celem artykułu jest wskazanie prawnych możliwości państwa w zakresie organizacji zgromadzeń publicznych. Problem badawczy został sformułowany w postaci pytania: W jaki sposób organy władzy publicznej, realizujące zadania z zakresu logistyki bezpieczeństwa państwa, swoim działaniem wypełniają konstytucyjną normę przyznającą osobie wolność zgromadzeń? Hipoteza badawcza poddana weryfikacji to: Władza publiczna ma szerokie możliwości zarówno w zakresie organizacji zgromadzeń publicznych, jak i zapewnienia ich bezpieczeństwa. Nie bez znaczenia dla logistyki bezpieczeństwa zgromadzenia publicznego jest okres między jego zgłoszeniem a odbyciem. Rozważania tematu zostaną oparte na dostępnej literaturze przedmiotu, aktach normatywnych, osobistych obserwacjach, a także innych źródłach informacji obrazujących przebieg i kontrolę zgromadzeń publicznych. Kluczowe znaczenie dla rozpatrzenia tematu będzie miała również ocena władz samorządowych dokonujących oceny zarejestrowanych manifestacji, a także ich wniosków o zezwolenie na odbycie zgromadzenia lub jego zakaz. Wnioski z przeprowadzonych badań zostały sformułowane w ostatniej części artykułu. Jako najistotniejsze wnioski wskazać należy, że, władza publiczna posiada szeroki zakres kompetencji zarówno w zakresie organizacji, jak i możliwości zapewnienia bezpieczeństwa publicznego. Ponadto, wprowadzona w 2015 roku znowelizowana ustawa o zgromadzeniach publicznych znacząco przyczyniła się do zwiększenia uprawnień samorządów.

Security is not a stable state, moreover it should not be taken for granted neither as something permanent. In everyday life there appear continuous threats, both origining either from the forces of nature or the unintended and intended effects of human activity. In order to ensure the desired level of safety, the security system is created in which the key component is logistics. The integration of logistics’ entities and strategic dimension of logistics (appreciation of the strategic function of logistics) cause the increase of the importance of integrated logistics systems and of security in logistics flows. Logistics activities aimed at optimization of the structures and processes within the network and logistics chains are playing an increasingly greater role from the perspective of safety management system.

Bezpieczeństwo nie jest stanem stabilnym, ponadto nie należy przyjmować go za pewnik ani jako coś trwałego. W życiu codziennym pojawiają się ciągłe zagrożenia, zarówno wynikające z sił natury, jak i jednostkowych i zamierzonych skutków działalności człowieka. W celu zapewnienia pożądanego poziomu bezpieczeństwa tworzony jest system bezpieczeństwa, w którym kluczowym elementem jest logistyka. Integracja podmiotów logistycznych i strategiczny wymiar logistyki (uznanie strategicznej funkcji logistyki) powoduje wzrost znaczenia zintegrowanego systemu logistycznego i bezpieczeństwa w przepływach logistycznych. Działania logistyczne mające na celu optymalizację struktur i procesów w sieci i łańcuchach logistycznych odgrywają coraz większą rolę z punktu widzenia systemu zarządzania bezpieczeństwem.

Współczesna logistyka ma już uznane i uzasadnione szerokie zastosowanie w procesach gospodarowania zasobami na rynku. Współczesność postrzega logistykę także w systemach bezpieczeństwa i obronności Państwa. Logistyka bezpieczeństwa łączy ze sobą dwa obszary: funkcjonowania Państwa, tj. system bezpieczeństwa i gospodarkę narodową. Zapewnia ona w tych systemach realizację procesów rzeczowych i informacyjnych strumieni przepływu. Logistykę bezpieczeństwa tak jak logistykę obrony i logistykę Sił Zbrojnych należy postrzegać w ujęciu systemowym. Tak postrzegana logistyka pozwoli zarazem na efektywne zasilanie rzeczowe systemu obronności Państwa.

The contemporary logistics has already recognized and justified widely used in the processes of resource on the market. Contemporaneity perceives logistics also in security systems and national defense. Security logistics combines two areas: the operation of the state, i.e. security system and the national economy. It provides in these systems implementation of material processes and information flow streams. Security logistics as well as defense logistics and Armed Forces logistics should be considered in terms of the system context. Logistics, perceived in such way, allows additionally efficient support for national defense.

Organizując Polski Kontyngent Wojskowy przeznaczony do realizacji zadań poza granicami kraju nie należy rozpatrywać wyłącznie kwestii operacyjnych, treści zadań mandatowych czy też składu bojowego kontyngentu. Czynnikiem nie mniej ważnym jest bezpieczeństwo logistyczne, które może zapewnić właściwie funkcjonujący system logistyczny. Mając to na względzie niezbędna jest wszechstronna analiza wszystkich determinantów wywierających wpływ na wielkość potrzeb logistycznych i warunki w jakich te potrzeby będą zaspokojone. Tylko taki pierwszy krok pozwoli właściwie zorganizować zabezpieczenie logistyczne. Zatem należy nie tylko znać ale potrafić zinterpretować czynniki warunkujące funkcjonowanie Polskiego Kontyngentu Wojskowego, a w tym wielkość i asortyment potrzeb logistycznych. Bazując na informacjach wynikających z uwarunkowań, koniecznością jest zastosowanie w praktyce zasad dotyczących sposobu realizacji zadań logistycznych. Zasady te powinny być znane i stosowane zarówno przez potencjał logistyczny jak i przez dowódców, którzy z działalności tej logistyki korzystają. Realizacja zadań zabezpieczenia logistycznego musi się mieścić w granicach obowiązującego prawa. Stad tez niezbędna jest znajomość określonych ustaleń jak również ich stosowanie w praktyce. Tak skomponowane składowe dotyczące organizacji zabezpieczenia logistycznego Polskiego Kontyngentu Wojskowego stanowią pozytywną bazę do praktycznego zaspakajania jego potrzeb logistycznych.

Organizing the Polish Military Contingent intended for tasks outside of the country should not be considered solely the operating issues, content tasks mandated or composition of the militancy of the quota. Factor not less important is the safety of the logistics, which can provide a properly functioning logistics system. With this in mind, it is necessary to comprehensive analysis of all determinants influencing the size of the logistical requirements and the conditions under which these needs are met. Only that first step will properly arrange security logistics. Therefore, you must not only know but be able to interpret the factors determining the functioning of the Polish Military Contingent, and in the volume and range of logistics needs. Based on the information under the circumstances, it is necessary to apply in practice the rules about the manner of the performance of the tasks of the logistics. These rules should be known and applied by both the potential logistical and military commanders, who with the activities of the logistics. Tasks of the logistics security must be within the limits of applicable law. Hence it is necessary to know the specific findings as well as their application in practice. Offers concerning the organisation of logistics security components of the Polish Military Contingent are positive for practical to satisfy its logistical requirements.

Autorzy publikacji, bazując na dostępnej literaturze oraz własnych doświadczeniach, przedstawili podstawowe wymagania dla systemów teleinformatycznych, które służą do przekazywania informacji. W opracowaniu ukazano także ważną rolę systemów teleinformatycznych oraz sieci telekomunikacyjnych, służących do wymiany danych w poszczególnych ogniwach systemu zabezpieczenia logistycznego. Następnie, zaprezentowano środki łączności i informatyki powszechnie wykorzystywane do wymiany informacji i danych przez różne podmioty, w tym działające na rzecz zabezpieczenia logistycznego. W części końcowej publikacji przedstawiono nowatorskie rozwiązania oraz technologie, które powinny umożliwić sprawny i bezpieczny obieg informacji pomiędzy elementami logistycznymi.

The authors, based on the available literature and our own experiences, presented the basic requirements for ICT systems that are used to communicate information. The study also shows the important role of ICT systems and telecommunications networks for sharing data in the individual cells of the logistics security system. Then, presented a means of communication and information technology widely used for the exchange of information and data by various entities, including acting for logistical support. In the final part of the paper presents innovative solutions and technologies that should allow for the smooth and safe flow of information between elements of logistics.
