The article presents basic definitions related to road accidents and types of tests carried out in the field of road accidents. The effects of road accidents on participants, drivers as well as social and direct costs of road accidents were discussed. The correct conduct of people involved in a road accident (incident) was presented. In the research part, the most common causes of accidents in Poland were analysed. Particular attention was paid to the participation in accidents of participants under the influence of alcohol. The article ends with a discussion on the presented research results and the resulting conclusions as well as a proposal for preventive actions to reduce the number of road accidents.

W artykule zaprezentowano zagadnienia odruchu bezwarunkowego na przykładzie zdarzeń drogowych, w tym kolizji i wypadków drogowych. Przedstawiono najważniejsze kwestie związane z zasadami odpowiedzialności karnej w prawie polskim, w tym koncepcją czynu oraz przybliżono prawne i psychologiczne aspekty odruchów bezwarunkowych i warunkowych, a także przywołano przykłady spraw karnych, w których wątek odruchu bezwarunkowego był analizowany w odniesieniu do odpowiedzialności sprawców przestępstw drogowych. Rozważania zostały uzupełnione omówieniem wybranych spraw cywilnych.

The aim of the paper is to present the issue of an unconditional reflex on the example of road incidents, in particular road collisions and accidents. There is no doubt that road traffic is a matter in which reflexes can carry a particular risk of dangerous situations. The study presents the most important issues related to the principles of criminal liability in the Polish law, including the concept of an act, introduces the legal and psychological aspects of unconditional and conditional reflexes, and gives examples of criminal cases in which the question of the unconditional reflex was analyzed in relation to the liability of perpetrators of road crimes. The discussed matter was supplemented with selected civil cases for damages and compensation for physical injuries and material losses suffered as a result of road accidents in which the suspicion of reflexes in the defendants also appeared.

Niniejsza publikacja skupia się na zagadnieniach definicji wypadku przy pracy, wypadku w drodze do pracy i wypadku w drodze z pracy. Poruszona została również problematyka wpływu na niezdolność do prowadzenia pojazdu mechanicznego z przyczyn chorobowych i przełożenia tej okoliczności na uprawnienia odszkodowawcze. Autorka zajęła się również materią zakresu i zasad ubezpieczenia w tzw. podróży służbowej, jak również zagadnieniu kształtowania się uprawnień odszkodowawczych w przypadku naruszenia przez ubezpieczonego przepisów prawa o ruchu drogowym. W pracy poddano analizie orzecznictwo sądowe odnoszące się do ww. problemów, sformułowane na przestrzeni lat 1997-2019.

This publication focuses on the issues of the definition of an accident at work, an accident on the way to work and an accident on the way from work, the issue of the impact of the inability to drive a motor vehicle due to illness and the impact of this circumstance on the right to compensation, matter of coverage and insurance rules in the so-called business travel, as well as the issue of shaping the right to compensation in the event of the insured's violation of traffic law. The paper analyzes court rulings related to the above-mentioned problems, formulated over the years 1997-2019.

In an atmospheric environment, a man is subjected to the influence of many factors of a stimulus nature, which probably affect into the behaviour of drivers in road traffic and the risk of them being exposed to certain road incidents. The aim of the paper was to answer the question whether weather conditions and what values of atmospheric parameters have an impact on the increase of the risk level regarding the occurrence of a road incident. The analyses were carried out using the road network in Elbląg as an example. There were based on detailed information regarding road incidents occurrence covering two years, and also atmospheric conditions that were made available. The work undoubtedly demonstrates that atmospheric conditions have an impact on considered risk. Moreover, the increase of this risk is highly influenced by atmospheric parameters such as humidity and air temperature.

W środowisku atmosferycznym człowiek podlega oddziaływaniu wielu czynników o charakterze bodźcowym, co w przypadku kierowców przekłada się potencjalnie na ich zachowania w ruchu drogowym oraz na poziom ryzyka narażenia na określone zdarzenia drogowe. W artykule podjęto próbę udzielenia odpowiedzi na pytanie, czy warunki pogodowe mają wpływ na wzrost poziomu ryzyka zdarzenia drogowego oraz jakie ewentualne wartości parametrów atmosferycznych decydują o tym w stopniu istotnym. Analizy przeprowadzono na przykładzie sieci drogowej Elbląga. Ich podstawą były zebrane z dwóch lat szczegółowe informacje dotyczące liczby wypadków drogowych oraz udostępnione dane warunków atmosferycznych, w jakich one zaistniały. W pracy wykazano, że warunki atmosferyczne wpływają bez wątpienia na rozważane ryzyko oraz że spośród parametrów atmosferycznych znaczny wpływ na jego wzrost mają między innymi wilgotność i temperatura powietrza.
