New technologies in real estate management and protection of privacy

The article examines the impact of new technologies on the property market, focusing on the integration of geospatial analytics with artificial intelligence (AI) to improve property management and gain competitive advantage. The analysis considers how AI tools, tailored to individual preferences, can assist in the management of large datasets that are critical to various sectors, including residential, commercial, office and hospitality. The primary research question addresses the extent to which the application of these innovative technological solutions affects privacy. The study identifies both challenges and potential risks, particularly in relation to privacy. It analyses the legal frameworks at national and European level, highlighting important similarities and differences. It concludes that current legal systems may struggle to adapt to the technological boom and the complexity of emerging technologies, in particular AI. The research highlights a gap in understanding the impact of advanced technologies on individual privacy and underlines the importance of responsible and ethical use of technology.

Purpose: discussion on threats to the right to privacy and measures of its legal protection in a smart city. Design/methodology/approach: analysis of legal provisions and socio-economic context. Findings: there are significant threats to the right to privacy in a smart city, posed by both private and public entities. There are, however, relevant national and EU regulations that protect the individuals. Those are usually sufficient, but can limit further development of smart cities. Originality/value: brief analysis of the existing threats to the right to privacy in a smart city, as well as indication of legal protection measures that apply and which, in some cases, may limit the development of a smart city in a long-term. The starting point for an in-depth analysis of future legal changes in national and EU law.

W pracy dokonano analizy obowiązujących w zakresie poszanowania prawa do prywatności aktów prawnych oraz istniejącego w tym zakresie orzecznictwa. Analiza ta niezbędna była do zaprezentowania nowej inicjatywy prawnej Unii Europejskiej jaką stanowić będzie system gromadzenia i wymiany danych dotyczących pasażerów (PNR). W pracy wskazano niebezpieczeństwa jakie mogą pojawić się w związku z istnieniem tego systemu, zasugerowano pewne drogi interpretacyjne oraz wskazano w jakim zakresie i w jakim kierunku regulacja będzie się rozwijała. Niezwykle poważnym niebezpieczeństwem, które również został uwzględnione jest możliwość braku proporcjonalności między poszanowaniem podstawowych praw jednostek a ochroną bezpieczeństwa państwa.

The paper presents an analysis applicable to the right to privacy and existing case law in this area. This analysis was necessary to present a new legislation initiative of the European Union. The initiative will provide a system for the collection and exchange of passenger data (PNR). The study indicates the dangers that may arise in connection with the existence of this system, suggested some ways of interpretation and pointed to what extent and in what direction regulation will develop. Extremely serious danger that had been taken into account also showed possible lack of proportionality between the respect for the fundamental rights of individuals and the protection of national security.

Rozwijające się przez stulecia koncepcje wolności i godności człowieka wpłynęły na ujmowanie pojęcia prywatności, a także kształt jej formalnoprawnej ochrony. W opracowaniu podjęto analizę wpływu przepisów wspólnotowych służących przeciwdziałaniu terroryzmowi, funkcjonujących w Unii Europejskiej, na sferę prywatną jednostki, skupiając się przede wszystkim na problematyce ochrony danych osobowych. W tym kontekście jednym z zadań, zarówno prawodawstwa, jak i polityki wspólnotowej, stało się obecnie złagodzenie antynomii dostrzegalnej pomiędzy potrzebami w zakresie zapewnienia bezpieczeństwa i ochrony społeczeństwa przed terroryzmem z jednej strony a zabezpieczeniem jednostki i społeczności przed coraz częstszymi naruszeniami prywatności związanymi z wykonywaniem regulacji antyterrorystycznych z drugiej strony.

Concepts of freedom and human dignity have evolved over the centuries. They contributed to the recognition of the concept of privacy and its legal and formal model of privacy protection. Study examines the impact of the European Union anti-terrorism legislation on the privacy of individuals. It focuses primarily on the issue of personal data protection. Ensuring the safety and protection of the public against terrorism leads in practice to frequent breaches of privacy. Both the legislation and the EU community policy intended to ensure that the necessary protection against terrorism as little as possible infringe individual rights, including the right to privacy.
