The infrastructure of spatial information as an example of opening public sector data in Poland

The subject of this article is the discussion of infrastructure for spatial information as an example of opening public sector data. The main aim of this paper is to identify the concept of opening public data. All areas of public administration activities at the national and local government level are more or less related to the use of spatial data. The article discusses the concepts of: spatial data, spatial information system. The article focuses on the work of the European Union on increasing the integration of spatial information systems. Polish public administration is becoming increasingly aware of the benefits of opening access to public data. This paper presents an enormous value of opening data, which should be disposed of appropriately and properly implement.

Rejestr Cen i Wartości Nieruchomości (RCiWN) jest bazą danych obejmującą przede wszystkim ceny określone w aktach notarialnych i wartości określone przez rzeczoznawców majątkowych w operatach szacunkowych. RCiWN stanowi część bazy danych przestrzennych infrastruktury informacji przestrzennej kraju oraz państwowego zasobu geodezyjnego i kartograficznego, a ponadto jest elementem infrastruktury informacji przestrzennej. Analiza regulacji prawnych RCiWN prowadzi do pewnych wątpliwości co do możliwości wykorzystania zawartych w nim danych. Istnieją co najmniej trzy akty prawne, z których wywodzić można zasady udostępniania ich zainteresowanym podmiotom. Wątpliwości odnoszą się przede wszystkim do katalogu podmiotów uprawnionych do uzyskiwania danych z RCiWN, odpłatności i sposobu naliczania opłat, możliwości nakładania ograniczeń co do dalszego rozpowszechniania danych i innego ich ponownego wykorzystania. Przedmiotem artykułu jest analiza prawna tych regulacji. Celem artykułu jest wyjaśnienie zasygnalizowanych wątpliwości poprzez interpretację aktualnych przepisów oraz sformułowanie postulatów de lege ferenda. Zakresem analizy objęto regulacje prawa geodezyjnego i kartograficznego oraz ustawy o infrastrukturze informacji przestrzennej wraz z przepisami wykonawczymi, odniesione do przepisów prawa autorskiego, ustawy o ochronie baz danych oraz ustawy o dostępie do informacji publicznej.

The Estate Price and Value Registry (RCiWN) is a database containing primarily the prices designated in notary deeds and the values determined by property valuers in appraisal reports. RCiWN is a part of the national geodetic and cartographic resources and, in addition, an element of the spatial information infrastructure. The legal analysis of RCiWN leads to certain doubts concerning the possibilities of using the data contained in the registry. There are at least three legal acts, from which rules of making the data available to the parties concerned may be derived. The doubts relate first of all to the catalogue of entities entitled to receive data from RCiWN, the rules concerning charges and the method of calculating them, the possibility to impose restrictions on further dissemination of data and their reuse. The subject of this paper is legal analysis of these regulations. The objective of this paper is to clarify the doubts indicated by means of interpretation of present provisions and formulating suggestions de lege ferenda. The scope of the analysis covers provisions of geodetic and cartographic law together with implementing provisions referred to the provisions of copyright law, the law on protection of databases and the law on access to public information.
