The purpose of this article was to evaluate the procedure for excluding land from agricultural production in the context of disclosing land use changes in the land and building records. In order to examine the problem presented, a descriptive analysis of existing legal acts and publications was performed, and a case study was analized. The research was based on data from 2010-2019 obtained from the District Eldership and District Center of Geodetic and Cartography Documentation in Kazimierza Wielka (Świętokrzyskie Voivodeship). The work presents subsequent stages related to the disclosure of changes in land development created on the land as a result of the start of the investment process. Attention was drawn to the extension of the investment process by the applicants for excluding land from agricultural production. Studies have shown that only 15% of decisions authorizing the exclusion of land from agricultural production in the Kazimierz District in the years 2010-2018 were actually implemented and completed with updating the land and building records. However, this is not a value corresponding to the real number of excluded areas, because based on the field interview, it can be indicated that only on 12% of the analyzed plots, the investment process was not started on the land. This is primarily due to the obligation to pay a fee for the sole exclusion of land from agricultural production, but also to a change in the method of calculating the tax from agricultural tax, to a several times higher property tax.

Niniejszy artykuł przedstawia badania związane ze zmianami, jakie zachodziły w ochronie gruntów rolnych począwszy od 2003 roku oraz wpływem jaki wywarła Ustawa z dnia 27 marca 2003 r. o planowaniu i zagospodarowaniu przestrzennym na te zmiany. Szczególną uwagę zwraca fakt, iż grunty rolne prawie za każdą nowelizacją prawa podlegają mniejszej ochronie prawnej, przez co są wykorzystywane na różne cele niezwiązane z rolnictwem, w tym budowlane. Przedstawione zostały wzajemne powiązania planowania przestrzennego oraz ochrony gruntów rolnych.

The paper showcases research regarding the changes that have occurred in the field of the protection of agricultural land since the year 2003, as well as the influence of the Spatial Planning Act of the 27th of March 2003 on these changes. Its chief focus is the fact that with each consecutive change of legislation, agricultural land becomes less and less protected, which results in its use for purposes other than agriculture, including construction. It also illustrates the mutual relationships between spatial planning and the protection of farmland.

W opracowaniu przedstawiono procedury związane z wyłączaniem gruntów rolnych położonych w granicach administracyjnych miast z produkcji rolniczej, w nawiązaniu do podstaw prawnych regulujących te kwestie. W lipcu 2014 r. została znowelizowana Ustawa o ochronie gruntów rolnych i leśnych z 3.02.1995 r. W odniesieniu do gruntów rolnych znajdujących się w granicach administracyjnych miast oznacza to, że z dniem 5.09.2014 r., po pięcioletniej przerwie, powróciła konieczność uzyskiwania zgody na wyłączanie ich z produkcji rolniczej przed rozpoczęciem procesu budowlanego. W artykule dokonano analizy zapisów ustawy po nowelizacji, w aspekcie możliwości ustanowienia szczegółowych procedur związanych z wydaniem decyzji administracyjnej, zezwalającej na wyłączenie gruntów z produkcji rolniczej. Na wybranych przykładach przedstawiono zasady obliczania należności za wyłączenie oraz związanych z tym opłat rocznych, po zastosowaniu odpowiednich zwolnień w konieczności ich wnoszenia przez inwestora. Zasadniczym celem opracowania jest podkreślenie trudności, powstających podczas wydawania decyzji oraz naliczeniu opłat, związanych z pewnymi niedoprecyzowaniami w obowiązujących przepisach prawa.

The paper presents the procedures related to the exclusion of agricultural land located within administrative boundaries of cities from agricultural production, with reference to the legal bases regulating these issues. The Act of 3rd February 1995 on the protection of agricultural and forest land was amended in July 2014. For agricultural land located within administrative boundaries of cities it means that, as of 5th September 2014, after a five-year break, a need to obtain a permission for their exclusion from agricultural production has returned, before the construction process can commence. The article analyzes the provisions of the Act after its amendment, in terms of the possibility to establish specific procedures relating to the issuance of an administrative decision authorizing the exclusion of land from agricultural production. The paper presents selected examples of principles for calculating exclusion fees and the related annual fees, after allowing for appropriate exemptions, as obligatory upon the investor's application. The main objective of this article is to emphasize the difficulties arising from the issuance of such decisions and from calculating accrued charges, related to certain inconsistencies in the applicable provisions of law.
