W artykule omówiono zagadnienie kwalifikacji do wykonywania czynności kierownictwa i dozoru ruchu odkrywkowych zakładów górniczych w świetle przepisów prawa geologicznego i górniczego. Przedstawiono wymagania w zakresie kwalifikacji, podmioty właściwe do sprawdzenia ich posiadania oraz sam proces sprawdzania.

In the light of the applicable provisions of the geological and mining law, performing activities in opencast mining plants requires qualifications in the form of Professional preparation and work experience. The legislator decided that for some of these activities, the determination of professional preparation and work experience is within the competence of the employer, while for the remaining activities the qualification requirements are specified in the law. Also in the case of checking the possession of qualifications, the legislator divided the competences and indicated that for some activities the checking of the possession of quaIifications is performed by the director of the district mining Office, while for the remaining ones - by the employer. The lines of these divisions of competences do not coincide, which is the source of many misunderstandings in the process of entrusting acti- vities in the opencast mining plant operation. The article describes a detailed division of competences in the scope of determining the requirements for qualifications and checking possession of these qualifications - in the light of the provisions of the Act of June 9, 2011 - Geological and Mining Law. In the case of defining the requirements, the scope of the terms „professional preparation" and „professional experience" was discussed, while in relation to checking the possession of these reguirements - the tasks of the entities to which the verification was entrusted.

Jednym z problemów, jaki powstał po deregulacji zawodu urbanisty w Polsce, było w praktyce zniesienie praktyk zawodowych dla osób, które mają sporządzać opracowania planistyczne na szczeblu miejscowym, gminnym i wojewódzkim. Zawód urbanisty, podobnie jak inne zawody związane z projektowaniem i planowaniem, wymaga doświadczenia i aktualnej wiedzy, żeby rzetelnie sporządzić konkretne opracowanie. W Polsce od 2014 r. projekty planistyczne może wykonywać wiele osób, które nie muszą mieć wiedzy praktycznej. Przez ostatnie kilkadziesiąt lat były w Polsce prawnie sankcjonowane wymogi posiadania nie tylko odpowiedniego wykształcenia, ale również odpowiednich kwalifikacji praktycznych przez osoby, które chciały wykonywać zawód urbanisty.

One of the problems that have arisen after the deregulation of the urban planning profession in Poland was the de facto abolishment of the requirement of internship for persons, that are to develop plans on the local, municipal and voivodship level. The profession of the urban planner, just like many other professions tied to design and planning, requires experience and cutting edge knowledge in order to properly develop a given piece of documentation. Since 2014, many persons have been enabled to develop urban designs without the necessary practical experience. Throughout the last couple of decades there had existed the legally sanctioned requirement of not only possessing the appropriate education, but also proper professional experience for persons who wished to work as urban planners.

Konieczność ustawicznego rozwoju zawodowego osób posiadających wyższe wykształcenie techniczne wynika w dużej mierze z wymagań formalnych, a kształcenie jest niezbędne z uwagi na szybki postęp wiedzy i techniki. "Kształcenie podyplomowe", którym określa się kształcenie osób, które ukończyły wyższe studia jest warunkiem utrzymania pozycji zawodowej, a szczególnie awansu naukowego czy zawodowego. Chciałoby się zacytować starą rzymską maksymę "disce aut discede" - "ucz się albo odejdż".

The need for technical graduates to undergo constant professional development is largely a result of formal requirements, but education is necessary in view of the rapid progress of knowiedge and technology. "Post-graduate training", meaning education for persons who have completed degrees, is a necessary condition for the maintenance of one's professional position, and particularly for professional or academic advancement. It is relevant to cite the old Roman maxim disce aut discede - "learn or leave".
