W artykule podjęto się próby ustalenia, czy obowiązujące przepisy określające zasady prowadzenia ewidencji gruntów i budynków mają charakter zasad lub domniemań prawnych, czy też jedynie typowych reguł prawa nakazujących organowi ewidencyjnemu (staroście) ściśle określone postępowanie rejestrowe, ale nieformujących ani obowiązku znajomości wpisu, ani domniemania prawnego znajomości wpisu czy też innych zasad i domniemań związanych z wiarygodnością danych ewidencyjnych ujawnionych w tym rejestrze. Wskazane zostały te normy prawa materialnego i procesowego, na podstawie których można odpowiednio sformułować zasadę prawdziwości wpisu i jego aktualności w rozumieniu ich zgodności z dokumentami źródłowymi stanowiącymi podstawę ich ujawnienia oraz wiarygodności ewidencji gruntów i budynków jako urzędowego rejestru publicznego.

The article attempts to determine whether the applicable provisions specifying the rules for keeping records of land and buildings have characteristics of legal principles or presumptions, or only typical legal rules requiring the registration authority (governor) to have strictly defined registration proceedings, but not requiring the knowledge of the record or having any legal presumption or knowledge related to the credibility of registration data disclosed in this register. The norms of substantive and procedural law have been indicated, on the basis of which the principle of truthfulness of the entry and its timeliness can be formulated in the sense of their compliance with the source documents constituting the basis for their disclosure and the credibility of the land and building records as an official public register.
