Na początku września 2019 roku weszło w życie wiele istotnych zmian w Kodeksie pracy, dotyczących między innymi mobbingu oraz ściśle z nim powiązanego, szeroko pojętego, równego traktowania. Z założenia wrześniowe zmiany mają ułatwić realizację uprawnień pracowniczych.

Artykuł, na tle ogólnej charakterystyki prawa karnego pracy i jego subsydiarności wobec prawa regulującego prawa pracownika, przedstawia przedmiot i podmiot ochrony oraz typy przestępstw regulowanych przez art. 218 kodeksu karnego. Na podstawie wyroku Trybunału Konstytucyjnego omawia też zasadę zakazu podwójnego karania w tej samej sprawie.

This article discusses the criminal law responsibility for the infringement of the rights of employees under Article 218 of the Penal Code in the light of the decision of the Constitutional Tribunal of 18 November 2010 considered ultima ratio. The article presents types of offences (misdemeanours) covered by this article of the Penal Code, which include: malicious or persistent infringement of the rights of employees, failure to comply with a legally binding court decision ordering employee reinstatement or the payment of remuneration or other benefits to the employee. These provisions ensure the protection of individual legal interests, which indicates their great importance because offences against the rights of employees are serious offences that infringe the constitutional principle of social equity. Recent police statistics reveal that there is a growing awareness of the importance of respecting the rights of employees since the number of such offences decreases year by year [28].

Although knowledge is cumulating, very little is known about the effects of various sources of support on safety and health compliance. This study goes beyond previous research by investigating the relationships among perceived support from organizations, supervisors and co-workers, and employees’ safety and health compliance behaviour at chemical and petroleum process plants. The results of this study show that the support from organizations, supervisors and co-workers was significantly related to employees’ safety and health compliance. Also, the findings reveal that perceived supervisor support has the strongest influence in ensuring employees’ safety and health compliance behaviour.

Ochrona pracy jest to zespół środków prawnych, ekonomicznych, organizacyjnych i technicznych mających na celu zabezpieczenie ogółu praw pracownika, wraz z ochroną jego życia i zdrowia, przed czynnikami niebezpiecznymi, szkodliwymi i uciążliwymi w środowisku pracy, a także zapewnienie zatrudnionemu optymalnych warunków pracy z punktu widzenia fi zjologii, ergonomii i psychologii.

Purpose: This paper discusses the issues of employee’s empowerment, their training needs, suggestions and other issues related to it. Total quality management (TQM) is a management technique adopted by the most manufacturing organizations. TQM in general is viewed as organization set up which will help to manufacture products at lowest cost by the following various management techniques through continuous improvement. Employee empowerment is providing decision making powers to a team or an individual. Design/methodology/approach: Employee empowerment is providing decision making powers for a team or individual. Findings: Employee empowerment is good for an organization and employee is empowered to make specific decision for the interest of the organization. Empowerment helps to play a wider role in an organization as a process owner. Research limitations/implications: This is a conceptual study, and hence, there is no hypothesis tested as an empirical study. It does provide a good foundation for future research. Originality/value: The paper is a conceptual design and more elaborative requirements can be done. This is an input to create awareness among the organizations.
