Artykuł stanowi opis procedury odbiorowej na gruncie nowej ustawy deweloperskiej, która weszła w życie 1 lipca 2022 r. Opisywany proces odnosi się do powszechnej sytuacji, gdy w lokalu lub domu jednorodzinnym ujawniła się wada na etapie poprzedzającym zawarcie z deweloperem umowy ostatecznej. Założeniem autorów artykułu jest opisowe przedstawienie przebiegu procedury odbiorowej w świetle skomplikowanego artykułu 41 nowej ustawy deweloperskiej, czyli ustawy o ochronie praw nabywcy lokalu mieszkalnego lub domu jednorodzinnego oraz Deweloperskim Funduszu Gwarancyjnym (Dz.U. z 2021 r. poz. 1177). Przepis ten na nowo zdefiniował reguły kreujące prawa i obowiązki stron umów, do których stosuje się opisywaną ustawę.

This article is a description of the acceptance procedure under the new Development Act, which came into force on 1 July 2022. The process described relates to the common situation where a defect has become apparent in a property or a single-family house at the stage preceding the conclusion of the final agreement with the developer. The intention of the authors of this article is to describe the course of the acceptance procedure in the light of the complicated Article 41 of the new developers Act, i.e. the Act on the Protection of the Rights of the Purchaser of a Dwelling or Single-Family House and the Developer's Guarantee Fund (Journal of Laws 2021, item 1177). This provision redefined the rules creating the rights and obligations of the parties to contracts to which the described Act applies.
