Artykuł omawia podstawowe zagadnienia związane z zasadą zapewnienia przez organy administracji publicznej udziału w postępowaniu administracyjnym następcom prawnym osób zmarłych oraz osobom nieznanym z miejsca pobytu, w tym: znaczenie tej zasady dla prawidłowego toku postępowania, czynności podejmowane w celu ustalenia stron postępowania, środki stosowane w przypadku śmierci osoby fizycznej lub braku wiedzy o miejscu pobytu strony, możliwe kierunki wykładni przepisów i trudności w zastosowaniu ich w praktyce, regulacje prawa wspólnotowego i międzynarodowego, regulacje szczególne, stanowiące odstępstwo od zasady zapewnienia czynnego udziału w postępowaniu, jak również konsekwencje naruszenia zasady zapewnienia stronom czynnego udziału w postępowaniu.

Ensuring that the parties to administrative proceedings are actively involved - them .is essential for the protection of their rights, as it provides the opportunity to influence the proper determination of the facts and the application of standards under substantive and procedural laws. Failure to comply with this principle constitutes a material defect in the proceedings as well as any administrative acts issued as a result.
