The article analyses the possibility of refraining from imposing an additional fee and an increased fee by public administration bodies, as provided for in the Geological and Mining Law. These fees are charged, among others, in the case of mining minerals without a concession or in breach of a concession. The provisions specifying the possibility of refraining from imposing an additional fee and an increased fee are contained in Article 189fof the Code of Administrative Procedure. However, some of the premises specified in this article do not apply to increased and additional fees. This applies in cases where the person threatened with the fee has already been punished for a crime or petty offence.
