Uncontrolled migration is one of the internal threats to the state that also manifests itself as a civilization problem. It illustrates the growing lack of social acceptance for this phenomenon. It is the result of not only geopolitical changes, but also the sequence of social dependencies. According to data from the census, over 99.8% are citizens of the Republic of Poland, and persons without citizenship amount to 57 thousand. It should be emphasized that in recent years more and more foreigners have come to Poland in search of a better life. Despite the influx of immigrants, Poland is a country with a negative balance, which proves that more people from Poland emigrate than to come to it. Accurate estimation of the scale of the phenomenon is not easy due to the adoption of the illegal dimension and that the Central Statistical Office and the Office for Foreigners otherwise collect and present information on foreigners. There are lot of intercultural differences connected with religion, tradition, customs and social behaviour. Often the barrier between the world of immigrants and the local society is so great that it creates conflicts in the places where immigrants reside, including anti-refugee protests, inclusive.

The article entitled “The management of a dysfunctional states in the aspect of contemporary threats of illegal immigration” aims to determine what the so-called dysfunctional states are, indicating specific features and problems related to their management. This is all the more important because – according to the author – dysfunctional states are the beginning of contemporary problems in Europe and the world concerning, for example, terrorism or illegal immigration. The second part of the article points to the key threats to democratic states caused by illegal immigration, which results, among others, from improper management (lack of management) of dysfunctional states.

Artykuł zatytułowany „Zarządzanie państwami dysfunkcyjnymi w aspekcie współczesnych zagrożeń związanych z nielegalną imigracją” ma na celu określenie, czym są tak zwane państwa dysfunkcyjne, wskazując na specyficzne cechy i problemy związane z procesem zarządzania nimi. Jest to tym ważniejsze, że – według autora – państwa dysfunkcyjne są początkiem współczesnych problemów w Europie i na świecie, dotyczących na przykład terroryzmu lub nielegalnej imigracji. Druga część artykułu wskazuje na kluczowe zagrożenia dla państw demokratycznych spowodowane nielegalną imigracją, wynikające m.in. z niewłaściwego zarządzania (braku zarządzania) państwami dysfunkcyjnymi.

Artykuł odnosi się do polityki migracyjnej Australii i Belgii. Dokonano w nim analizy i oceny zastosowanych instrumentów instytucjonalno-prawnych, m.in. takich jak metody walki z nielegalną imigracją, polityka migracji powrotnych, polityka integracyjna, kursy adaptacyjne, polityka antydyskryminacyjna, partycypacja polityczna, testy obywatelskie, dostęp do rynków pracy, pozyskiwanie wysoko wykwalifikowanych pracowników, system punktowy. Na przykładzie państw typowo imigracyjnych, z których jedno jest, a drugie nie jest członkiem Unii Europejskiej, pokazano, jak zastosowanie pewnych mechanizmów polityki migracyjnej może wpłynąć na bezpieczeństwo państwa. W odniesieniu do nielegalnej imigracji przeanalizowano środki ograniczające wielkość napływającego strumienia cudzoziemców, a także ukazano społeczną ocenę tego zjawiska, w tym wypowiedzi przedstawicieli władz państwowych.

The article is descriptive of the migration policies of Australia and Belgium. It analyzes and evaluates the institutional and legal instruments applied to these policies, including such methods as combating illegal immigration, return migration policy, integration policy, adaptation courses, anti-discrimination policy, political participation, civic tests, access to labor markets, recruitment of highly qualified employees, point system. By the exemplification of important issues for the typical immigration countries, as those described, one of which is, and the other is not a member of the European Union, author shows how applying certain mechanisms of migration policy may affect the security of the state. In relation to illegal immigration, the measures limiting the size of the incoming stream of foreigners were also analyzed, and a social assessment of migration phenomenon, including the statements of representatives of state institutions, were also presented.

Unia Europejska od 2015 roku musi stawić czoła nielegalnej migracji na Morzu Śródziemnym aby zapobiec masowemu napływowi imigrantów. Działania przez nią podejmowane w postaci operacji cywilnych i wojskowych przynoszą określone efekty. Autorka, biorąc pod uwagę dane statystyczne z połowy roku 2017 dokonuje negatywnej oceny ich dotychczasowej skuteczności prezentując pogląd, że wpływają one wręcz motywująco na decyzje uchodźców/imigrantów o przedostaniu się do państw Europy, gdyż zapewniają przyjęcie na pokład jednostek ratunkowych i dostarczenie do portów UE. Biorąc pod uwagę powyższe autorka przewiduje, że w kolejnym roku UE będzie kontynuować te operacji, gdyż są one postrzegane jako ratujące życie ludzkie na morzu, które jest najwyższą wartością, ale cele operacji będę osiągane tylko połowicznie.

The European Union from year 2015 must confront illegal migration at the Mediterranean Sea to prevent the mass influx of immigrants. The action taken, in the form of military and civilian operations, produces certain effects. The author, taking into account the statistical data from the middle of the year 2017, made a negative assessment of their current effectiveness of the operations and presents the view that they rather motivate the refugees/immigrants to take the passage to Europe, because they provide help to boats and deliver survivals to EU ports. Given the above the author predicts that in the next year, the EU will continue these operations, because they are seen as life-saving human life at sea, which is the highest value, but the objectives of operation will be achieved only partially.

W artykule przedstawiono dokumenty Unii Europejskiej, których zapisy stanowią o problemie nielegalnej imigracji dotykającym państwa członkowskie. W poszczególnych dokumentach zajęto się szukaniem rozwiązań ograniczających najczęstsze formy nielegalnej imigracji, jaką jest przerzut osób i handel ludźmi. Unia zobowiązała się zapobiegać handlowi ludźmi i zwalczać go oraz chronić prawa ofiar handlu. Kolejne zapisy ujęte w unijnych regulacjach wskazują m.in. na konieczność redukcji nielegalnej imigracji, przyjazną politykę dla migracji legalnej, skuteczne zarządzanie granicami zewnętrznymi, rzetelną politykę powrotów oraz wypracowanie wspólnej polityki imigracyjnej.

The article presents the documents of the European Union with entries on the problem of illegal immigration affecting the Member States. Within those documents there may be found the solutions for the most common forms of illegal immigration: transport illegal immigrants and human trafficking. The European Union is committed to the prevention of, and fight against human trafficking, and protection of the rights of trafficked persons. In addition particular attention should be paid, according to the author, to measures discouraging and reducing illegal immigration, friendly politics for legal migration, effective border management, politics of returns and common immigration policy.

In the article there was presented the problem of illegal immigration by sea to the Kingdom of Spain. The size and characteristics of illegal immigration by sea were given with characteristics of used floating measures. Against this background were presented legal bases, tasks and organization of the Guardia Civil and its activities in dealing with illegal immigration by sea.
