Przedstawiono istotne dylematy związane z pozyskiwaniem energii geotermalnej na tle obowiązującego stanu prawnego, dokonując jego omówienia w podziale na projektowanie i realizację inwestycji, eksploatację zasobów geotermalnych oraz zakończenie funkcjonowania instalacji geotermalnych. Jednocześnie uwzględniono specyfikę i odrębności związane z celami, dla których energia geotermalna jest przetwarzana oraz sposobami, w jakie ową energię udaje się pozyskać. W konkluzji skupiono się na dostrzeżonych wątpliwościach, wraz ze wskazaniem potrzeb, co do zmian legislacyjnych.

In the text there are shown essential problems connected with resource of the geothermal energy, associated with factual and legal circumstances, by its coverage in division for project and realization of investment, exploitation of geothermal resources and the end of working its installations. Simultaneously in the text it's been taken into consideration the specify and separations irrelevant with purposes for which the geothermal energy is processed and ways of an acquisition of that energy. In the summarize it's been focused on noticed doubts, in the legislation changes. In Poland, geothermal energy is derived from many years, although, the relatively smali. Now, after joining the European Union, there are indications of substantial use it not only for heat but also electricity. In addition to technical and economic factors affecting the development of geothermal energy plays a significant role in a need for a elear legal solutions at every stage of this kind of projects, from design and implementation through the development of resources and ending with the eventual completion of the operation. Made findings show that both the objectives for which the energy is processed, and how it affects obtain the appropriate application of the rules. It was also found regulatory gaps in both the presence and the need to revise the current regulations.

Przedmiotem rozważań są prawne aspekty wydobywania wód termalnych, rozpatrywane na kanwie wyroku Naczelnego Sądu Administracyjnego z dnia 27 marca 2002 r. W tekście skupiono się na ocenie, czy w przypadku pobrania ciepła oraz jego sprzedaży dochodzi do wydobywania kopaliny i jest wymagane z tego tytułu uiszczenie opłaty eksploatacyjnej, a sama eksploatacja wód termalnych jest rodzajem szczególnego korzystania z wód, wymagającym pozwolenia wodnoprawnego. Rozważono też, czy materiał wtłaczany z powrotem do górotworu posiada charakter ścieku, optując za tym, iż jest on odpadem. Odchodząc od ram materii wykreowanych analizowanym stanem faktycznym dostrzeżono również, że specyficzne rozwiązania techniczne mogą mieć wpływ na kryteria związane z pozyskiwaniem energii geotermalnej z wód.

The subject of the considerations is legal aspects of thermal waters mining examined on the grounds of the Supreme Administrative Court decree of 27th March 2002. The text focuses on the assessment whether the case of energy drawing and selling means mineral excavation and thus exploitation fee should be paid and the exploitation itself is a sort of particular waters use that requires hydrolegal license. It was also considered if the material forced back into the orogen is sewage opting for that it is waste. Departing from the frames of matters created by the analysed factual condition it was also pointed out that specific technical solutions may effect the criteria connected with gaining geothermal energy from waters.
