Odnawialne źródła energii (OZE) stanowią coraz istotniejszy element zaspokajania potrzeb energetycznych przemysłu i indywidualnych użytkowników na całym świecie. Ich rozwój przekłada się na zmniejszenie emisji CO2 i potencjalne ograniczenie efektu cieplarnianego, jak również inicjuje postęp technologiczny w odnośnych dziedzinach. W artykule przedstawiono konfiguracje przydomowej mikro-instalacji, wytwarzającej energię elektryczną, użytkowanej w północnej części kraju. Omówiono kierunki i przesłanki jej modernizacji, pokazano wyniki pomiarów ilości produkowanej energii oraz dokonano analizy efektywności jej wytwarzania w kontekście energetycznym, ekonomicznym, jak i otoczenia prawnego zagadnień OZE.

Renewable energy sources (RES) are becoming increasingly important in the world to meet the energy needs of industry and individual users. Their development also affects the reduction of CO2 emissions and potential reduction of greenhouse effect as well as initiates technological progress in relevant areas. This article presents the configuration of household electrical micro-installation that is used in the northern part of Poland. The directions and reasons for its modernization were discussed. The results of the measurements of the amount of energy produced and the analysis of the efficiency of its production, in the energy, economic and legal context were considered. Technical conditions and legal regulations for RES systems in Poland are still not favorable. Private investors build RES systems at their own risk. Currently, the return period on investment in this area is far from the information contained in the advertising of RES equipment. Increasing the rates for resale electrical energy and subsidizing the construction of the RES plants will certainly help to expand the pool of potential investors. In response to a question in the title of the article: it can be profitable.

Uchwalona przez Radę i Parlament Europejski dyrektywa 2009/28/WE nałożyła na każde z państw członkowskich obligatoryjne obowiązki w zakresie realizacji celów dotyczących m.in. wzrostu udziału energii pochodzącej z odnawialnych źródeł wytwórczych (OZE) i spowodowała, że w perspektywie 2020 roku konieczne stało się podjęcie ściśle określonych działań – zarówno w obszarze energetyki wielkoskalowej, jak i energetyki prosumenckiej. Zgodnie z art. 4 tej dyrektywy każde z państw członkowskich zostało zobligowanie do przygotowania planu działania, który okresowo aktualizowany, powinien określać drogę oraz wszystkie środki służące realizacji celów OZE. Polski Krajowy Plan działania na rzecz OZE uchwalono decyzją Rady Ministrów dnia 5 grudnia 2010 roku. Zawierał on koncepcję wdrożenia dyrektywy o promocji energii z OZE w formie dedykowanego aktu prawnego, tzw. Ustawy o OZE (UOZE), która miała regulować m.in. kwestie energetyki prosumenckiej. Jak wiadomo, wspomniany akt prawny powstawał bardzo długo, przedstawiane były różne pomysły i koncepcje, przekładające się na następne projekty ustaw i nowelizacje. Pierwszy projekt UOZE został przedstawiony pod koniec 2011 roku, natomiast obecnie obowiązujący akt prawny funkcjonuje wraz z najnowszą nowelizacją od połowy 2016 roku. Niniejszy artykuł prezentuje, jak kształtowało się polskie ustawodawstwo energetyczne dotyczące wsparcia energetyki prosumenckiej. Podjęto ponadto próbę przedstawienia, czy i w jaki sposób poszczególne, proponowane przez Ustawodawcę rozwiązania wpływały na polską energetykę prosumencką i jej rozwój.

Directive 2009/28/WE adopted by the European Parliament and the Council imposed obligatory duties on all UE member states to achieve targets like, among the others, increase in the use of energy coming from renewable sources (RES) and also made it necessary, in the 2020 perspective, to take clearly defined actions both in the area of a large-scale power generation and the prosumer energy. According to the Article 4 of the Directive every member state is obliged to prepare a plan of actions which periodically updated should set the path and all measures serving the RES targets realization. The Poland National Renewable Energy Action Plan was adopted by Decision of the Council of Ministers of 5 December 2010. It contained the concept to implement a directive on the promotion of the use of energy from RES in the form of a dedicated legislative act, the so-called RES Act, that would also regulate questions related to prosumer energy. As it is known, the mentioned legislative act has been coming into being for quite a long time, in the company of arising in the meantime various ideas and concepts which then resulted in consecutive draft acts and amendments. The first project of the RES Act was presented at the end of 2011 while the current Act, accompanied by the latest amendment, has been in force since mid 2016. It is described here how the Polish energy legislation was shaped in the part relating to prosumer energy support. Moreover, an attempt is made to present whether and how the individual and proposed by the legislator solutions were influencing the Polish prosumer energy and its development.

W pracy przedstawiono rynek fotowoltaiczny w Polsce na tle Europy. Zestawiono ilość mocy zainstalowanej w Polsce oraz liczbę firm z obszaru PV na koniec 2012 roku. Przytoczono najnowsze uregulowania prawne dotyczące fotowoltaiki wprowadzone w tzw. małym trójpaku energetycznym oraz propozycję zmian do nowej ustawy o OZE. Skomentowano przedstawione plany i wynikające z nich szanse i zagrożenia dla inwestorów. Przedstawiono proponowane programy wsparcia i dofinansowania inwestycji.

This paper presents the photovoltaic market in Poland against the background of Europe. Number of the installed capacity and the number of companies in the field of PV at the end of 2012 is specified. The latest regulations regarding of photovoltaics introduced in the so called little energetic three-pack and the proposed changes to the new law on renewable energy was quoted. Plans and contracts arising there from opportunities and risks for investors were presented and commented. The paper presents the proposed program of supporting and financing the investment.

Przedstawiono zainteresowanie Rządu R.P. intensyfikacją pozyskiwania energii ze źródeł odnawialnych. W tym celu utworzono w Ministerstwie Gospodarki Departament Energii Odnawialnej i opracowano projekt ustawy o źródłach odnawialnych. W projekcie wprowadzono elastyczne i czytelne zasady wsparcia w zakresie wytwarzania energii z odnawialnych źródeł. Wsparcie dla mikro i małych instalacji to głównie efekt dyrektywy UE, która proponuje takie rozwiązania. Celem proponowanych regulacji jest stworzenie możliwości wykorzystywania lokalnie występujących zasobów, stąd też promocja energetyki rozproszonej.

The interest of the Polish Government in intensification of obtaining the energy from renewable sources is presented. Accordingly, the Renewable Energy Department has been set up in the Ministry of Economy, and a respective bill prepared on renewable energy surces. The bill introduces flexible and clear support rules for generation of the energy.The support for micro and small installations is mainly due to the EU directive proposing respective solutions. The purpose of the regulations proposed is to allow the use of local resources, hence the promotion of distributed generation has been assumed.
