Since 2023, underground carbon dioxide storage activity may be performed as industrial (rather than demonstrative as before). Currently, it may only be carried out within the Polish Exclusive Economic Zone of the Baltic Sea. Determining the suitability of a given geologic structure for the purpose in question takes place on the basis of a decision approving the project of geological operations, preceded by the decision on environmental conditions. A license for the underground storage of carbon dioxide must be preceded by an environmental impact assessment and the applicant must be the owner of the land on which the mining plant is to be located. However, meeting this condition within marine areas is not possible. It is feared that it will take many years to obtain all the decisions authorizing such activity and that it will be impossible to comply with some of the obligations set out in the Geological and Mining Act.

The consequence of overly detailed and discretionary regulation is an increased investment risk. With regard to geological and mining activities, this concerns, inter alia, scope of licensing, coordinations or opinions on mineral license by non-licensing authorities, the local development planning system and the requirements for environmental impact assessments. These solutions require urgent simplification.
