W artykule przedstawiono regulacje prawne dotyczące ostatniego etapu likwidacji odkrywkowych zakładów górniczych, jakim jest rekultywacja gruntów po działalności górniczej. Autorzy - sprawujący obsługę prawną OUG w Poznaniu rozwijają, na tle działalności Urzędu, zagadnienia o udziale organów nadzoru górniczego w procesie rekultywacji.

In this article presented are legal regulations pertaining to the last stage of liquidation of open-cast mining units, ie. the reclamation of lands abandoned after mining operations. Against the background of the activity of the Mining Area Administration (OUG) of Poznan the authors- who render legal consultancy services to the UOG - are dwelling upon the problems of participation of the mining supervision organs in the process of land reclamation.

Likwidacja odkrywkowego zakładu górniczego Cementowni Groszowice była procesem długotrwałym i złożonym. Prawo geologiczne i górnicze nakłada na przedsiębiorcę likwidującego zakład górniczy liczne obowiązki dotyczące sfery działań formalno-prawnych, organizacyjnych i technicznych, mających na celu zabezpieczenie pozostawionych w złożu zasobów kopaliny, ochronę złóż sąsiednich, ochronę środowiska oraz rekultywację umożliwiającą zagospodarowanie terenów przekształconych. Ruch likwidowanego zakładu górniczego kontrolują organy nadzoru górniczego.

The liquidation of the open pit mining unit of Groszowice Cement Plant has been a long-lasting and complex process. The Geological and Mining Law imposes numerous duties on the liquidation Operator of the Mining Unit in the area of formal, legal, organisational and technical procedures aimed at preserving the mineral reserves left in the natural deposits, environment protection and reclamation that allows for further development of the lands undergone the reclamation scheme. The running of mining unit under liquidation is under control of mining supervision organs.

Artykuł przedstawia aktualny stan wiedzy na temat likwidacji odkrywkowych zakładów górniczych na przykładzie likwidacji odkrywki Pątnów KWB "Konin" w Kleczewie S.A. Zawarto w nim dane doświadczalne i wyniki pomiarów dokonane w ciągu ostatnich dwóch lat podczas napełniania zbiornika końcowego odkrywki Pątnów. Omówiono również niektóre aspekty prawne procesów związanych z rekultywacją terenów pogórniczych. Dużo uwagi poświęcono zagadnieniom monitoringu hydrochemicznego wód zbiornika Pątnów oraz monitoringu zjawisk równowagi brzegowej zachodzących w czasie napełniania zbiornika.

The article presents the actual level of knowledge on liquidation of open pit mining operation units basing on the example of liquidation of the Lignite Strip Mine of Patnow KWB "Konin" w Kleczewie S. A. Included in it are the experimental data and measurement results obtained over a period of the recent two years in the course of filling of the tail end storage bin of the recent two years in the course of filling of the tail end storage bin of the Patnow Strip Mine. Also discussed are some legal aspects of the procedures connected with lend reclamation of the post-mining areas. A great deal of attention has been given to the issues of hydrochemical monitoring of Patnow reservoir waters and monitoring of the reservoir embankment balance phenomena occuring in the course of filling the reservoir.

W 2001 roku zakończono wydobycie węgla brunatnego z odkrywki Pątnów, wchodzącej w skład Kopalni Konin. W artykule przedstawiono przyjęty sposób likwidacji odkrywki, opisano dokonane przygotowania do jej likwidacji oraz przebieg prac zmierzających do zagospodarowania terenów objętych eksploatacją górniczą.

In 2001 mining of lignite had been stopped in Patnów open pit, one of the open pits belonging to Konin lignite mine. So far in this mine, three open pits were liquidated; Morzysław, Nieszłusz, and Gosławice. Together with beign in liquidation Patnów pit 129.783.127 tons of lignite were mined and 563.805.405 m3 of overburden deposits were displaced. Liquidation of Pątnów pit is managed according to "Mine Liquidation Plan", which was elaborated according to requirements of Mining Code. The final result, envisioned in "Mine Activity Plan" is management of this complex process in a way that will not only prevent degradation of natural environment but also will be beneficiary for ex-mining areas and people living in that region. The liquidated pit will be turned into water reservoir, which after complete water filling will occupy area of 346 hectares and together with adjacent grounds will total in 448 ha. Reclamation will also cover adjacent to mine Pątnów-Adamów-Konin Power Plant mining waste and ash dumping sites covering in total area of 360 ha. The pit will be filled mostly by underground waters infiltrating trough the pit bottom and its North, East and South slope (Fig. 4) as well as by rainfall waters. In order to accelerate the process of reservoir filling, ground works were performed to allow water flow from settling ponds, in which treatment of brown waters from dewatering of Pątnów pit, delivared from pumping station located at the bottom of the pit, and sewage waters from assembly area in Dąbrowa, occurred. The quality of waters drained to the pit is within the II class of cleanless and is controlled by Regional Environmental Protection Service. Water reservoir created at the pit will serve multipurpose tasks like: leisure, fishing, and retention. It is planned that reservoir will be filled by water within four years. After completion of reclamation, water reservoir together with adjacent areas will be handled for management to county Ślesin. The separate, , howeover, very important problem is financing of pit liquidation process. Besides internal found, gathered during the time of pit mining, the mine will used preferential loans from National and Regional Funds for Environmental Protection and Water Management. For the overall pro-ecological activities related to reclamation of de-mined areas Konin Mine was awarded the Wielkopolski Certificated of Quality.
