W artykule wskazano nowe uregulowania w zakresie odpowiedzialności karnej w ochronie środowiska, jak również podjęto próbę uzyskania odpowiedzi na pytanie, na ile normy prawa karnego są faktycznie skuteczne w ochronie środowiska.

6 December 2008 announced the Directive 2008/99/EC of the European Parliament and of the Council of 19 November 2008 on the protection of the environment through criminal law. On the European continent increased/rised environmental offences, their effects are increasingly extending beyond the crossberder. The existing system have not been sufficient to achieve complete compliance with the laws for the protection of the environment. Implementation of the directive was change in the Polish Penal Code, in crimes against environment.
