Problem of water scarcity in agriculture – case study of land improvement in Kujawsko-Pomorskie Voivodship

Today’s agriculture is facing a range of challenges, the most important of which is the adjustment to the changing climate. In this context, water management is particularly vital. Droughts in Poland are becoming more and more frequent. That fact adds to the significance of irrigation and drainage systems. This paper is an attempt at diagnosing the condition of (in 2016) and changes in (over the period of 2006–2016) irrigation and drainage systems in the Kujawsko-Pomorskie Voivodship (analysed by communes, until 2016 – according to Local Administrative Units – LAU level 2). The multidirectional analysis involves a comprehensive description of ameliorated lands, including the allocation of the EU funds dedicated for the support of flood protection and land improvement ventures. It has been demonstrated that the present condition of land improvement does not reflect the needs of the agriculture in the studied area and that the changes implemented on the ongoing basis fail to make the situation better. In 2016, slightly over 40% of agricultural acreage was ameliorated, while the level at which land improvement needs would be satisfied approximated 70%. In over 1/5 of the ameliorated area, facilities needed reconstruction or modernisation. Drainage systems were in the majority, which indicates that the current needs, i.e. water scarcity, are not addressed.

Dzięki m.in. pozyskiwaniu środków z funduszy Unii Europejskiej budujemy i modernizujemy coraz więcej dróg, szklaków kolejowych, obiektów mających zapewnić ochronę w czasie powodzi i wiele wiele innych. Tak olbrzymia liczba i różnorodność inwestycji wymaga od projektantów i wykonawców stosowania coraz to nowszych i bardziej wydajnych technologii budowlanych, dzięki którym można budować nie tylko szybciej i sprawniej, ale też coraz mądrzej obchodzić się z zasobami naturalnymi.

Poland has been experiencing an investment boom recently. Owing to, inter alia, the funds raised from the European Union, we build and upgrade more and more roads, railway routes, flood protection facilities and many other things. So huge number and diversity of projects requires from designers and contractors to use up-to-date and more efficient construction technologies allowing them to build faster and more efficiently, but also handle natural resources more wisely.

Uchwalenie nowej ustawy Prawo wodne jest ważnym wydarzeniem dla wszystkich podmiotów prowadzących działalność z zakresu szeroko rozumianej gospodarki wodnej. Dotyczy to także tego jej wycinka, którym są melioracje wodne. W znacznej części schemat unormowań przypomina znany już z ustawy z 1974 r. Pojawiają się jednak również pewne modyfikacje przepisów, których znaczenie prawne nie zawsze jest łatwe do ustalenia. Dokonany w niniejszym artykule przegląd przepisów Prawa wodnego nawiązuje do systematyki ustawy. Obejmuje on zasady ogólne, definicje i typy urządzeń melioracji wodnych, kwestie związane z własnością i obowiązkiem utrzymywania takich urządzeń. Przedmiotem uwagi są również opłaty melioracyjne, a także ewidencja wód, urządzeń melioracji wodnych oraz zmeliorowanych gruntów. Omówienie przepisów ustawy poprzedzają rozważania poświęcone znaczeniu tzw. Ramowej dyrektywy wodnej dla przyszłości działalności melioracyjnej.

The adoption of the new Water Law Act has to be considered as an event important for all the stakeholders involved in activities connected with the water management, including also land improvements. The new provisions are - to a large extent - similar to those provided by the previous Water Law Act of 1974. Nevertheless, the new Act includes also some modifications that legal meaning is in some cases unclear - those problems have been indicated in the discussion initiated in the literature on the subject by P IETRUSZEWSKI [2003]. A review of Water Law Act provisions as presented in this article is linked to the system of the Act. It encompasses general principles, definitions and types of land improvement facilities, as well as issues connected with ownership and obligations of maintenance of such facilities. The article deals also with land improvement fees and record-keeping of waters, land improvement facilities and improved lands. A review of Water Law provisions has been preceded by analysis of the importance of the Water Framework Directive for future activities concerning land improvement.
