Przedstawiono problem szacowania zabezpieczania roszczeń osób trzecich, w tym Skarbu Państwa, na etapie procesu koncesyjnego. Na przykładzie cyklu życia hipotetycznej kopalni węgla brunatnego oszacowano koszty zabezpieczenia potrzebnych środków na realizację aktualnych i przyszłych zobowiązań przedsiębiorcy w zakresie naprawy szkód w środowisku. Problem analizowano dla trzech charakterystycznych scenariuszy organizacji produkcji. Obliczenia przedstawiono jako proces kumulacji zobowiązań oraz kosztów ich realizacji, z których wynika, że poważnym problemem jest gromadzenie środków na rekultywacje. Realne zabezpieczenie funduszy na ten cel możliwy jest przez tworzenie rezerw finansowych w ramach MSR 37, a ich zabezpieczenie powinno być ubezpieczone od niewypłacalności przedsiębiorcy. Jak pokazują obliczenia koszt takiego ubezpieczenia wynosi ułamek procenta wielkości przychodu kopalni.

The problem of claims security estimation of third persons, including the State Treasury, at the stage of the concession process has been presented. On the example of the life cycle of a hypothetical lignite mine the costs of security of necessary means for the realisation of current and future obligations of the entrepreneur with respect to damage reparation in the environment have been estimated. The problem was analysed for three characteristic scenarios of production organisation. The calculations were presented as the process of cumulation of obligations and costs of their realisation, from which it results that a serious problem is the accumulation of means for rehabilitation. Real security of funds for this purpose is possible through the creation of financial reserves in the framework of MSR 37, and their security should be insured against the entrepreneur’s insolvency. Calculations show that the costs of such insurance amount to a percentage fraction of the mine’s income.
