Polska elektroenergetyka stoi przed wieloma wyzwaniami determinowanymi zmianą modelu funkcjonowania systemów elektroenergetycznych. Przeprowadzono identyfikację tych wyzwań, przyjmując jako punkt odniesienia różne perspektywy postrzegania systemu elektroenergetycznego. Pozwoliło to na wskazanie najistotniejszych, które mogą implikować konieczność zmiany dotychczasowego, sprawdzonego historycznie, podejścia do elektroenergetycznej automatyki zabezpieczeniowej. Właściwa interpretacja tych wyzwań wydaje się szczególnie istotna. Jest to determinowane istotnością roli pełnionej w systemie elektroenergetycznym przez elektroenergetyczną automatykę zabezpieczeniową.

The Polish electrical power system is facing a number of challenges. These challenges are determined by the currently observed and expected future directions of the development of power systems. Identification of these challenges was performed. In the analysis, different perspectives of perception of power system as a reference point were assumed. This allowed identifying the most important factors. The publication focuses on the characterization of the most important factors identified as these which may cause the necessity to change the current approach to power system protection.

Wprowadzenie Rozporządzenia Komisji Unii Europejskiej 2016/1447 z dnia 26 sierpnia 2016 r., ustanawiającego kodeks sieci dotyczący wymogów w zakresie przyłączenia systemów wysokiego napięcia prądu stałego oraz modułów parku energii z podłączeniem prądu stałego, nakłada na operatorów sieci elektroenergetycznych (systemów elektroenergetycznych) poszczególnych krajów członkowskich obowiązek opracowania zapisów dookreślających wymogi zawarte w tym Rozporządzeniu. W artykule przedstawiono charakterystykę zakresu tematycznego Rozporządzenia, zestawiono sugestie implementacyjne sformułowane przez ENTSO-E oraz zamieszczono opis ogólnych i szczegółowych czynników determinujących kształtowanie zapisów dookreślających wymogi Rozporządzenia.

Introduction of the Regulation of the European Union Commission 2016/1447 of 26 August 2016, establishing a network code regarding requirements for connecting DC high voltage systems (HVDC) and power park modules with DC-connected, imposes on electricity network operators (power systems) the obligation to develop provisions specifying the requirements contained in this Regulation. The article presents the characteristics of the thematic scope of the Regulation, presents implementation suggestions formulated by ENTSO-E and shows a description of general and specific factors determining the formation of provisions that specify the requirements of the Regulation.

Poniższy artykuł stanowi rozwinięcie oraz uszczegółowienie tematyki związanej z procesem wdrażania unijnych kodeksów sieci i wytycznych, przedstawionej w artykule Jacka Ratza i Roberta Kielaka „Jednolity rynek energii w Europie i kodeksy sieci”, opublikowanym w nr 1/2017 magazynu „Elektroenergetyka”. Artykuł skupia się na zagadnieniach formalnych i prawnych, jakie identyfikowano na obecnym etapie procesu wdrażania europejskich kodeksów sieci i wytycznych, w szczególności w zakresie kodeksów sieci w obszarze przyłączania. Zagadnienia te poruszone zostały również przez autora w trakcie spotkania otwartego, dotyczącego wdrażania kodeksów sieci i wytycznych, które odbyło się w siedzibie PSE SA w Konstancinie-Jeziornie w dniu 5 lipca 2017 r.

The article presents chosen legal and regulatory aspects considered during national implementation process of European Network Codes and Guidelines. In the article author describes: general issues concerning European Network Codes and Guidelines, as well as their purpose, mostly from the perspective of purposes of so-called Third Energy Package, the issue of understanding the term “implementation” in relation to Network Codes and Guidelines, objective scope of connection Network Codes, the possibilities of Member State to adopt legal provisions in certain cases, some of the ENTSO-E and ACER responsibilities in the implementation procedure and chosen legal issues raised during implementation process, like the issue of position of the decisions adopted on the basis of Network Codes and Guidelines in the national legal act hierarchy. The article was prepared as an extension of the article “Single market in Europe and network codes” of J. Ratz and R. Kielak, published in Elektroenergetyka magazine no 1 (16)/2017 and of the open meeting for interested stakeholders concerning Network Codes and Guidelines that took place in PSE SA promises in Konstancin-Jeziorna on 5th July 2017.

W artykule przedstawiono główne uwarunkowania związane z powstawaniem kodeksów sieci oraz ich potencjalny wpływ na funkcjonowanie energetyki krajowej.

The article presents main conditions related to the formulation of network codes and their potential impact on the functioning of domestic power industry. The entry of codes into effect means the need to undertake a number of activities related to the adjustment to new regulations. These activities are carried out on European and domestic levels. Due to the entry into force of network codes, a number of obligations have been imposed on the transmission system operator, distribution system operators and several other entities in the power sector. Currently, work related to the fulfilment of these obligations is under way. Acceleration of the process of building the European energy market has triggered the need to work out a large number of legal regulations providing formal grounds for the introduction of new solutions and amending the existing mechanisms. New regulations force a broader opening of all segments of domestic power markets and their gradual harmonisation towards a single European market, which should considerably improve the situation of market participants through the further development of competition, enhancing liquidity and making access to market easier. Activities related to safeguarding equal access to information and energy market transparency as well as regulating rules of granting state aid for energy market participants in particular Member States are also being carried out. Although the European Commission declares that full implementation of existing legal framework by all Member States is necessary to complete the construction of the internal power market, the proposal [9] of the Energy Union (winter package) formulated in November 2016 announces a number of subsequent legislative amendments. These amendments are supposed to guarantee the establishment of the Energy Union, understood as five areas of mutual impact, i.e. energy security, integrated internal energy market, Energy efficiency, decarbonised economy as well as research and innovations. As part of this initiative, the European Commission has announced the undertaking of a number of activities that will guarantee the implementation of the Energy Union, including new proposals of legislative amendments of great importance for the electrical power generation industry.
